Abstract
La presente investigación tuvo como objetivo determinar la influencia de la tecnología en el estudio de la escena del crimen y su aplicación por parte de los peritos de la Oficina de Criminalística de la Policía Nacional del Perú (OFICRI- PNP) y la Oficina de Peritajes del Ministerio Público (OPERIT-MP), según el Nuevo Código Procesal Penal, en las jurisdicciones de Lima, Cajamarca, Ayacucho y Chimbote, ello con la finalidad de orientar el fundamento que representa la necesidad de optimizar los servicios periciales y garantizar elementos de convicción suficientes para la administración de justicia. Se menciona que el uso de la tecnología puede ser fundamental para mejorar los informes periciales y apoyar la toma de decisiones de los operadores de justicia. En cuanto al abordaje metodológico, se trata de una investigación de tipo básica y descriptiva, con un enfoque cualitativo. El estudio realizado se llevó a cabo en la OFICRI-PNP y la OPERIT-MP, los sujetos de investigación fueron los peritos adscritos a estas instituciones. La población y muestra fueron equivalentes, y se utilizó técnicas para la recolección de datos, entre ellas: como encuestas y análisis de documentación bibliográfica.
Entre los resultados obtenidos, se señala, falta de laboratorios criminalísticos y la aplicación de técnicas e instrumentos antiguos con alto margen de error son deficiencias en la recolección de indicios y de evidencias en la escena del crimen y/o lugar de los hechos, vienen generando debilidades en el sustento técnico-científico requerido por la OFICRI-PNP en las ciudades de Lima, Cajamarca, Ayacucho y Chimbote, y la OPERIT-MP, en su misión institucional de ser el soporte para la mejor toma de decisiones por parte de los operadores de justicia.
The objective of this investigation was to determine the influence of technology in the study of the crime scene and its application by the experts of the Criminalistics Office of the National Police of Peru (OFICRI-PNP) and the Experts Office of the Public Ministry (OPERIT-MP), according to the New Criminal Procedure Code, in the jurisdictions of Lima, Cajamarca, Ayacucho and Chimbote, with the purpose of guiding the foundation that represents the need to optimize expert services and guarantee sufficient elements of conviction for the administration of justice. It is mentioned that the use of technology can be essential to improve expert reports and support the decision-making of justice operators. Regarding the methodological approach, it is a basic and descriptive type of research, with a qualitative approach. The study carried out was carried out at the OFICRI-PNP and the OPERIT-MP, the research subjects were the experts assigned to these institutions. The population and sample were equivalent, and data collection techniques were used, among them: such as surveys and analysis of bibliographic documentation. Among the results obtained, it is pointed out, the lack of crime laboratories and the application of old techniques and instruments with a high margin of error are deficiencies in the collection of indications and evidence at the crime scene and/or place of the facts, they have been generating weaknesses in the technical-scientific support required by the OFICRI-PNP in the cities of Lima, Cajamarca, Ayacucho and Chimbote, and the OPERIT-MP, in its institutional mission of being the support for the best decision-making by the operators of Justice.
