The current penal code of 2004, is based on the adversarial system with adversarial trend, having as one of its main features the separation of functions, where the evidentiary will be deployed by the warring parties, who are intended to act their evidentiary material at trial and thus be able to convince the judge on his theory of the case and obtain a decision favorable to their claims.
