El síndrome de alienación parental como causa de variación de tenencia

Abstract

El Síndrome de Alienación Parental (SAP) es el desorden causado en un hijo, como resultado de las peleas entre el padre y la madre para obtener la tenencia de los hijos. Surge cuando uno de los padres interrumpe el vínculo de afecto entre su hijo con la ex pareja, mayormente con el que no vive. En otros países ya se está regulando dicho síndrome en la legislación civil, penal o en leyes especiales; también de manera indirecta, sin embargo en nuestro país existe un vacío normativo sobre la regulación del SAP, lo que origina un estado de desamparo del menor de edad, que continúa viviendo con el progenitor alienante, y sufre de constante maltrato psicológico, y ve menoscabado su vínculo con el otro progenitor; el menor de edad vive en un ambiente perjudicial que no permite desarrolle sanamente su personalidad. Asimismo, ve afectado su derecho de vivir con su familia, lo cual implica a ambos padres, abuelos, tíos, etc. Siendo necesario para el menor de edad retirarse del ambiente donde vive, e irse con su otro progenitor, pues el padre alienante también sufre de esta enfermedad y no es la persona idónea para el cuidado de un niño, además de necesitar un tratamiento psicológico. La solución para reconstruir el vínculo padre o madre e hijo, y brindar el ambiente adecuado para la formación del menor de edad, en consecuencia, su formación en valores y en su personalidad, asimismo garantizar el goce pleno de su derecho a vivir en familia y a ser cuidado por ella, es la variación de tenencia de manera progresiva.

Parental Alienation Syndrome (SAP) is the disorder generated in a child, as a result of disputes between mother and father about child custody. It is starts when they obstructs the relationship with the child, usually the parent who lives without the girl or the boy. A lot of countries have in their civil, penal codes or in special laws rules about it, however, in our country does not exist anything law about it, this situation generates the child has not protected, who lives with alienating parent, and their will be damage in their minds, the child lives in a bad environment, that is not good for their personality development. Also, they are affecting the right of child must live with their family, that include parents, grandparents, uncles, etc. The child must be move away and go out with the other parent, because the alienating parent is insane and he or she is not the best option for take care the child. Also he or she needs go to the physiologist. The solution for the parents will be having a good relationship in the future and they will take care and educate their child, they will be use the right to live in a family and take care for there is the judge varies the custody progressively.
