Abstract
El presente trabajo de investigación tiene como fin el estudio de la política pública consistente en la cuota de empleo para PCD, que se encuentra regulada en el artículo 49.1 de la Ley N° 29973, Ley General de la Persona con Discapacidad, bajo el siguiente tenor: “Las entidades públicas están obligadas a contratar personas con discapacidad en una proporción no inferior al 5% de la totalidad de su personal, y los empleadores privados con más de cincuenta trabajadores en una proporción no inferior al 3%”. (Diario El Peruano : Ley 29973, 2012) Nosotros restaremos atención a la aplicación de la referida disposición en el ámbito privado, ya que, aparentemente, vulnera la libertad de contratación laboral que se sustenta en el derecho constitucional de libertad de empresa.
