Abstract
El presente trabajo de investigación se orienta a demostrar, en base a criterios
doctrinales, la afectación del derecho al fraccionamiento de las deudas tributarias en
los gobiernos locales en los casos de procedimiento coactivo con medida cautelar
trabada, específicamente, en el Servicio de Administración Tributaria de Trujillo, y
así evitar afectaciones indebidas e innecesarias a este derecho reconocido en el inciso
n) del artículo 92 del Código Tributario.
Asimismo, se pretende demostrar que no existe criterios objetivos para
restringir el derecho de fraccionamiento en los casos de deuda tributaria en
procedimiento de cobranza coactiva con medida cautelar trabada en el Servicio de
Administración Tributaria de Trujillo, para ello se ha efectuado un desarrollo teórico
del derecho al fraccionamiento.
Debemos tener en cuenta que las normas vigentes deben ser coherentes con los
principios constitucionales del derecho, por lo que la interpretación y la aplicación de
las normas no pueden contravenirlas ni vulnerarlas.
Con el presente trabajo se busca que el derecho al fraccionamiento de la deuda
tributaria en el procedimiento de cobranza coactiva, sea ejercido por los
contribuyentes de los gobiernos locales de forma plena, incluso cuando haya recaído
medida cautelar efectiva, siempre y cuando no se haya efectuado el cobro de la deuda
o el remate de los bienes, tal cual sucede con el procedimiento seguido en la SUNAT
y ante otras municipalidades distritales de la provincia de Lima; evitando de esta forma
afectar a los contribuyentes con deseo de pagar su deuda aunque no cuentan con
efectivo total.
Finalmente, hemos llegado a la conclusión que es necesario una reforma
legislativa en materia tributaria, a fin de garantizar los derechos del contribuyente, de
tal forma que los sujetos de la obligación tributaria sean beneficiados: El Estado
porque se le pagaran los tributos con sus respectivos intereses y el contribuyente
porque puede fraccionar su deuda, y cancelarla sin afectar su economía.

This research work is oriented to demonstrate, on the basis of doctrinal criteria, the
affectation of the right to fractionation of tax debts in local governments in cases of
coercive procedure with locked precautionary measure, Specifically, in the service of
tax administration of Trujillo, and thus avoid undue restrictions to this right recognized
in the section n) of article 92 of the tax code.
It is also intended to demonstrate that there are no objective criteria to restrict the right
to fractionation in cases of tax debt in coercive collection procedure with a
precautionary measure, for this has been carried out a theoretical development of the
right to Fractionation.
We must bear in mind that the rules in force must be consistent with the constitutional
principles of law, so that the interpretation and application of the rules cannot be
contravened or violated.
With this work, it is sought that the right to fraction of the tax debt in the coercive
collection procedure be exercised by the taxpayers of the local governments in full,
even when it has relapsed effective precautionary measure, always And when the
collection of the debt or the auction of the goods has not been carried out, as is the
case with the procedure followed in the SUNAT and before other district
municipalities; thus avoiding to affect taxpayers with a desire to pay their debt
although they do not have total cash Finally, we have reached the conclusion that a legislative reform in tax matters is
necessary, in order to guarantee the taxpayer's rights, so that the taxable persons are
benefited: the state because they will be paid the Taxes with their respective interests
and the taxpayer because they can divide their debt, and cancel it without affecting
their economy.
