| dc.description | Reproductive medicine’s development has enabled to palliate the infertility effects through the Assisted Reproductive Technology. In the face of the lack of regulation about those techniques, there are legal problems about single woman’s access to them, among the most important we have those relating to filiation, weighting between mother's rights and child's superior interest, access to lesbian couples and its use as an alternative method. Also, a study of comparative law is performed in order to establish which countries let the access to single woman and which ones not. In the face of a possible Law on Assisted Reproductive Techniques in our country, it is necessary to establish the access to them, prohibiting to single woman to use them, making the child's superior interest prevail over the woman’s unilateral wish of been a mother | es_PE |
| dc.description.abstract | El avance de la medicina reproductiva ha permitido paliar los efectos de la infertilidad a través de las Técnicas de Reproducción Humana Asistida. Ante la falta de regulación de esas técnicas, se evidencian problemas jurídicos en torno al acceso de la mujer sola a ellas, entre los más importantes tenemos los referentes a la filiación, a la ponderación entre derechos de la madre y el interés superior del niño, el acceso de parejas lesbianas y a su uso como método alternativo. Asimismo, se realiza un estudio de legislación comparada, para establecer en qué países se permite el acceso a mujeres solas y en cuáles no. Ante una posible Ley sobre Técnicas de Reproducción Humana Asistida en nuestro país, se hace necesario delimitar el acceso a las mismas, impidiendo que la mujer sola pueda hacer uso de dichas técnicas haciendo que el interés superior del niño prime sobre el deseo unilateral de la mujer a ser madre | es_PE |
