El control jurisdiccional amplio del indulto humanitario y la inmutabilidad del principio de la cosa juzgada

Abstract
El presente trabajo de investigación tiene como objetivo determinar existencia de una
relación significativa entre la procedencia del control jurisdiccional amplio sobre la
prerrogativa presidencial del indulto humanitario establecido por el Tribunal Constitucional
en su expediente N° 03660-2010-PHC/TC y la inmutabilidad del principio de la cosa
juzgada.
La investigación es básica y diseño descriptivo correlacional, el tamaño de la muestra fue de
12 operadores jurídicos que laboraron en el Distrito Judicial de la Libertad y Lima Norte en
el 2022 y los instrumentos empleados fueron la guía de análisis documental, la guía de
entrevista y las fichas de investigación.
Entre los resultados, el indulto humanitario es un acto político sujeto en su fase de gestión a
control administrativo (Bolivia) o político (Ecuador), o judicial sin carácter vinculante
(Argentina), se identifican casos indultos humanitarios objeto de control jurisdiccional como
de José Crousillat revocado por Alan García Pérez y de Alberto Fujimori revocado por
control de convencionalidad.
Se concluye que existe relación significativa entre la procedencia del control jurisdiccional
amplio del indulto humanitario establecido por el Tribunal Constitucional y la inmutabilidad
del principio de la cosa juzgada, al dejar sin efecto el acto de concesión otorgado por el
presidente de la república, y se recomienda un control parcial administrativo o político en su
fase de gestión.
The objective of this research work is to determine the existence of a significant relationship between the origin of the broad jurisdictional control over the presidential prerogative of humanitarian pardon established by the Constitutional Court in its file No. 03660-2010- PHC/TC and the immutability of the principle of the thing judged. The research is basic and correlational descriptive design, the sample size was 12 legal operators who worked in the Judicial District of La Libertad and Lima Norte in 2022 and the instruments used were the documentary analysis guide, the interview guide and research sheets. Among the results, the humanitarian pardon is a political act subject in its management phase to administrative control (Bolivia) or political control (Ecuador), or judicial without binding character (Argentina), cases of humanitarian pardons subject to jurisdictional control are identified, such as José Crousillat revoked by Alan García Pérez and Alberto Fujimori revoked due to conventionality control. It is concluded that there is a significant relationship between the origin of the broad jurisdictional control of the humanitarian pardon established by the Constitutional Court and the immutability of the principle of res judicata, by leaving without effect the act of concession granted by the president of the republic, and it is recommended partial administrative or political control in its management phase.
