Abstract
La investigación surge ante las dificultades para identificar a los autores, la falta de jurisprudencia, y el aumento de casos del delito de cybergrooming, delitos en los que personas contactan a menores a través de plataformas como WhatsApp, Facebook e Instagram para proponerles actos de connotación sexual. Se propone diseñar una inteligencia artificial como agente encubierto digital, capaz de ayudar en la identificación de delincuentes, obtención de pruebas y análisis del modus operandi. El estudio se desarrolló en dos fases: una teórica, que abarcó un análisis doctrinario, legal y jurisprudencial; y otra de campo, que incluyó entrevistas a 10 operadores jurídicos (abogados, fiscales y jueces) para obtener sus opiniones sobre la creación de esta inteligencia artificial. Se emplearon varios métodos para el análisis de la información: hermenéutico jurídico, teórico, inductivo, deductivo y lógico. Las técnicas de recolección de datos incluyen observación, análisis de documentos, entrevistas y estadísticas, presentando los resultados en tablas de frecuencia y figuras estadísticas. Los resultados demostraron la necesidad de implementar una inteligencia artificial como agente encubierto digital, facilitando la identificación de autores, localización, obtención de pruebas digitales y análisis de modos de operación, pero respetando los derechos fundamentales y evitando inducir al delito.
ABSTRACT The investigation arises from the difficulties in identifying the authors, the lack of jurisprudence, and the increase in cases of the crime of cybergrooming, crimes in which people contact minors through platforms such as WhatsApp, Facebook and Instagram to propose acts of connotation. sexual. It is proposed to design artificial intelligence as a digital undercover agent, capable of helping in the identification of criminals, obtaining evidence and analyzing their modus operandi. The study was developed in two phases: a theoretical one, which covered a doctrinal, legal and jurisprudential analysis; and another in the field, which included interviews with 10 legal operators (lawyers, prosecutors and judges) to obtain their opinions on the creation of this artificial ntelligence. Several methods were used to analyze the information: legal hermeneutic, theoretical, inductive, deductive and logical. Data collection techniques include observation, document analysis, interviews and statistics, presenting the results in frequency tables and statistical figures. The results demonstrated the need to implement artificial intelligence as a digital undercover agent, facilitating the identification of perpetrators, location, obtaining digital evidence and analysis of modes of operation, but respecting fundamental rights and avoiding inducing crime.
