Abstract
La presente investigación se origina por la preocupación que se tiene por la conducta ética del personal al servicio del Estado. Por ello, se inicia el presente trabajo describiendo la situación ética que atraviesa nuestra Administración Pública, para luego evaluar la incorporación a su normatividad de los procedimientos que diseñan la “Infraestructura Ética”; modelo que busca y ha logrado asegurar una conducta ética del personal que labora en la Administración Pública de los países miembros de la Organización y Cooperación para el Desarrollo (OCDE), de la cual el Perú aun no es parte, pero que aspira a serla. Para evaluar la procedencia de la incorporación de este modelo, se ha analizado la normatividad marco de la función estatal sobre ética pública, evaluando de esta manera la Ley Marco del Empleo Público; que trata de estructurar operacionalmente y regular la política ética aplicada a la función pública en nuestro país. Asimismo, la investigación trata de identificar las propiedades de la infraestructura Ética para determinar si es posible incorporarlas a la Ley Marco del Empleo Público, considerando que esta normatividad aún está pendiente de ser integrada por leyes de desarrollo. Nuestra hipótesis radica en que los presupuestos de la Infraestructura Ética si pueden incorporarse a nuestra legislación y en base a ello se desarrolla la presente tesis, estructurada en los sub capítulos: antecedentes; Función Pública; Ética en la Función Pública; Infraestructura Ética; derecho comparado; y, finaliza con las conclusiones y recomendaciones.

This research arises from the concern you have for the ethical conduct of personnel working for the state. Therefore, this paper begins by describing the ethical situation facing our Public Administration, and then assess the addition to its regulation of procedures designed the "Infrastructure Ethics"; model that seeks and achieved ensure ethical conduct of personnel working in the public administration of the member countries of the Organization for Cooperation and Development (OECD), of which Peru is still not a party, but aspiring to be it. To evaluate the appropriateness of incorporating this model, we analyzed the framework of state regulations on public ethics function, thus evaluating the Public Employment Framework Law; that is operationally structured and regulates political ethics applied to public service in our country. The research also seeks to identify the properties of the ethics infrastructure to determine whether it is possible to incorporate the Framework Law on Public Employment, considering that this regulation has yet to be integrated by laws of development. Our hypothesis is that the budgets of the Ethics Infrastructure can be incorporated into our legislation and on that basis this thesis is built. It is structured in sub chapters: history; Public Service; Ethics in Public Office; Ethics infrastructure; comparative law; ending with conclusions and recommendations.
