Abstract
La investigación planteada tiene como objetivo determinar de qué manera la aplicación del proceso peculiar de terminación anticipada en la etapa intermedia del proceso penal peruano influye en salvaguardar los principios de celeridad, economía y elasticidad procesal. Se realizó una investigación cualitativa descriptiva, mediante el uso del método hermenéutico y el acopio bibliográfico. El análisis ha comprendido el acuerdo plenario 5-2009/CJ-116 sobre terminación anticipada, lo planteado por el autor Sánchez Velarde en su libro: “El nuevo proceso penal peruano” y lo desarrollado por el Decreto Legislativo Nº 957, que desarrolla el Nuevo Código Procesal Penal. Se obtuvo, tras el análisis una correlación entre las fuentes y el objetivo de salvaguarda de los principios procesales. Se concluye que la utilidad de la terminación anticipada en la etapa intermedia salvaguarda estos principios. Así mismo, se recomienda unificar criterios respecto a esta cuestión planteada y difundir el estudio de este tipo de investigaciones para el desarrollo de nuestro proceso penal vigente.
ABSTRACT The proposed investigation aims to determine how the application of the special process of early termination in the intermediate stage of the Peruvian criminal process influences the safeguarding of the principles of speed, economy and procedural elasticity. A descriptive qualitative research was carried out, through the use of the hermeneutic method and the bibliographic collection. The analysis has included the plenary agreement 5-2009/CJ-116 on early termination, what was proposed by the author Sánchez Velarde in his book: "The new Peruvian criminal process" and what was developed by Legislative Decree No. 957, which develops the New Criminal Procedure Code. After the analysis, a correlation was obtained between the sources and the objective of safeguarding the procedural principles. Concluding that the application of early termination in the intermediate stage safeguards these principles. Likewise, it is recommended to unify criteria regarding this issue and disseminate the study of this type of research for the development of our current criminal process.
