Abstract
El presente trabajo de investigación, tesis para optar el grado Profesional de
Abogado, denominado: “La aplicación del precedente vinculante Huatuco y la
afectación a la estabilidad laboral en los juzgados laborales de Trujillo”, tiene
como finalidad demostrar que el precedente constitucional vinculante Huatuco
Huatuco, el cual se encuentra contenido en la Sentencia del Tribunal constitucional del Expediente Nº 05057-2013-PA/TC, vulnera los principios constitucionales y derechos laborales que ostentan todos los trabajadores, entre estos y de manera particular, los trabajadores de las entidades públicas sujetos al régimen de la actividad privada común, los cuales, a diferencia de los trabajadores del mismo régimen que laboran en entidades privadas, no pueden reclamar la reposición como vía idónea de protección frente a un despido arbitrario, a consecuencia de la entrada en vigencia del precedente vinculante Huatuco Huatuco, significando así, una evidente falta de protección a los derechos del trabajador y una total regresión del derecho laboral. La presente tesis busca evidenciar las razones por las cuales los principios
constitucionales y derechos laborales que ostenta todo trabajador, deben ser
protegidos frente a cualquier otra norma interna.
ABSTRACT This research work entitled: “The application of the binding Huatuco precedent and the impact on labour stability in the labour courts of Trujillo”, aims to demonstrate that the binding constitutional precedent Huatuco Huatuco, which is contained in the Constitutional Court's ruling on file No. 05057-2013-PA/TC, violates the constitutional principles and labour rights enjoyed by all workers, including, in particular, the workers of public entities subject to the system of common private activity. which, unlike the workers of the same regime who work in private entities, cannot claim reinstatement as an ideal means of protection against arbitrary dismissal, as a result of the entry into force of the precedent binding Huatuco Huatuco, thus signifying a clear lack of protection of workers' rights and a total regression of labor law. This thesis seeks to highlight the reasons why the constitutional principles and labor rights of all workers should be protected against any other domestic norm.
