| dc.description.abstract | La problemática constante de los daños que derivan de accidentes de tránsito permite identificar a partir de la práctica judicial, la figura constante de la imprudencia de la víctima empleada por el demandado con la finalidad de eximirse o atenuar la responsabilidad, en ese sentido esta investigación tiene como propósito evidenciar la valoración de la imprudencia de la víctima que realiza el juzgador en la determinación de la responsabilidad extracontractual por accidente de tránsito de tal manera que se justifique o no realizar el traspaso del peso económico del daño sobre el demandado. Para ello se ha tenido en cuenta los elementos de la responsabilidad extracontractual y de forma específica de la responsabilidad objetiva por ser aplicable a estos casos según la Ley General de Transporte y Tránsito Terrestre, Ley 27181, así como el desarrollo de la imprudencia de la víctima desde la perspectiva de la doctrina nacional y comparada. Se han analizado los criterios que la jurisprudencia de la Corte Suprema ha desarrollado sobre el tema y de forma especial se analizó los criterios del juez civil de Trujillo referidos a la valoración de la imprudencia de la víctima para finalmente determinar si dicho criterio justifica o no la determinación de la responsabilidad civil sobre el demandado. | |
| dc.description.abstract | ABSTRACT The constant problem of the damages that derive from traffic accidents allows to identify from the judicial practice, the constant figure of the recklessness of the victim used by the defendant with the purpose of exempting himself or mitigating the investigation, in that sense this investigation has The purpose is to demonstrate the assessment of the imprudence of the victim made by the judge in determining the non-contractual liability for a traffic accident in such a way that the transfer of the economic weight of the damage to the defendant is justified or not. To this end, the elements of non-contractual liability have been taken into account and specifically of strict liability as it is applicable to these cases according to the General Law of Transport and Land Traffic, Law 27181, as well as the development of the imprudence of the victim. from the perspective of national and comparative doctrine. The criteria that the jurisprudence of the Supreme Court has developed on the subject have been analyzed and in a special way the criteria of the civil judge of Trujillo referring to the assessment of the recklessness of the victim were analyzed to finally determine if said criterion justifies or not the determination of civil liability on the defendant. | |
