Abstract
El trabajo de investigación se realiza con el propósito de responder la interrogante planteada ¿La imputabilidad de los adolescentes que cometen infracciones graves regulado en el Código de Responsabilidad Penal vulnera el Principio de interés superior del niño?, para la obtención de la información de nuestro problema, determinaremos si la imputabilidad penal de los adolescentes que comete infracciones graves vulnera el principio de interés superior del niño, analizando la medida socioeducativa de internamiento, determinando los lineamientos que establece la Convención de los Derechos del Niño a los Estados Partes ante infracciones penales cometidas por adolescentes, determinar el modelo de justicia penal juvenil para adolescentes que vulneran la ley penal y por último, determinar los alcances convencionales del Principio de Interés Superior del niño. Para ellos aplicaremos las técnicas de análisis documental, acopia documental, fichaje e interpretación normativa, cuyos resultados se presentaron en tablas de resumen. Para la discusión de resultados se utilizaron métodos tales como: análisis, síntesis, inductivo, deductivo, histórico y hermenéutico. Se concluyó que: el legislador ha optado como la mejor solución, el aumentar el tiempo de duración de la medida de internamiento para adolescentes que cometen delitos graves, A través de los artículos 37 y 40 la convención es clara al garantizar el trato digno y respetuoso de los derechos humanos de los adolescentes infractores. Teniendo así, el derecho a acceder a un sistema de justicia penal especializada que tenga en consideración su condición de especial por ser personas en proceso de formación y maduración. La justicia penal restaurativa es un mecanismo civil para resolver conflictos. El Principio de Interés Superior del niño es la satisfacción integral de los derechos del menor y debe ser considerado como principio rector – guía y de observancia obligatoria para todos los Estados. Finalmente, los instrumentos complementarios (Reglas de Beijing, Directrices de RIAD y reglas de la habana) tienen como finalidad, guiar a los Estados en el tratamiento de los adolescentes en conflicto con la ley penal.
ABSTRACT The research work is carried out with the purpose of answering the question posed: Does the imputability of adolescents who commit serious offenses regulated in the Code of Criminal esponsibility violate the Principle of the best interests of the child?, To obtain information on our problem , we will determine whether the criminal responsibility of adolescents who commit serious offenses violates the principle of the best interests of the child, analyzing the socio- educational measure of internment, determining the guidelines established by the Convention on the Rights of the Child to the States Parties in the face of criminal offenses committed by adolescents, determine the model of juvenile criminal justice for adolescents who violate criminal law and finally, determine the conventional scope of the Principle of Higher Interest of the child. For them we will apply the techniques of documentary analysis, document collection, signing and normative interpretation, the results of which were presented in summary tables. For the discussion of results, methods such as: analysis, synthesis, inductive, deductive, historical and hermeneutical were used. It was concluded that: the legislator has chosen as the best solution, to increase the duration of the internment measure for adolescents who commit serious crimes, Through articles 37 and 40 the convention is clear in guaranteeing dignified and respectful treatment of the human rights of adolescent offenders. Thus, having the right to access a specialized criminal justice system that takes into consideration their special condition because they are people in the process of training and maturing. Restorative criminal justice is a civil conflict resolution mechanism. The Principle of Higher Interest of the child is the comprehensive satisfaction of the rights of the minor and should be considered as a guiding principle - guiding and mandatory for all States. Finally, the complementary instruments (Beijing Rules, RIAD Guidelines and Havana rules) are intended to guide States in the treatment of adolescents in conflict with criminal law.
