La admisión de la prueba que no califica como extemporánea: una perspectiva desde la carga de la prueba

Abstract
La presente investigación tiene como finalidad evaluar la práctica utilizada por los jueces laborales de la Corte Superior de Justicia de La Libertad, respecto a la admisión de medios probatorios ofrecidos como extemporáneos, los cuales pese a no reunir los requisitos exigidos según el artículo 21 de la Nueva Ley Procesal de Trabajo son incorporados al proceso en aras de alcanzar la verdad de cada una de las causas que resuelven. Al respecto, tomando en consideración que dicho escenario se genera desde el ofrecimiento mismo por parte de los abogados litigantes y, consecuentemente, se desarrolla en la oportunidad de admisión a cargo del juez, quien como director del proceso deberá tomar las decisiones más apropiadas sin que ello represente una subrogación de las partes procesales en su carga probatoria, abordamos dicha problemática con la intensión de verificar si constituye una vulneración de los principios fundamentales que componen el debido proceso, sustancialmente del principio de oportunidad y lealtad procesal, bajo una estricta evaluación de las cargas probatorias que le asiste a cada parte procesal.
ABSTRACT The purpose of this investigation is to evaluate the practice used by the labor judges of the Superior Court of Justice of La Libertad, regarding the admission of evidentiary means offered extemporaneously, which in spite of not meeting the requirements of Article 21 of the New Labor Procedural Law are incorporated into the process in order to achieve the truth of the cases they resolve. In this regard, considering that this scenario is generated from the offer of evidence made by the lawyers and, consequently, developed at the time of admission by the judge, who, as the director of the process, must make the most appropriate decisions without this representing a subrogation of the parties in their burden of proof; we address the problem with the intention of verifying whether this constitutes a violation of the fundamental principles of due process, specifically the principles of procedural opportunity and procedural fairness, under a strict evaluation of the burden of proof on each party.
