La Actividad Probatoria en el Proceso Contencioso Administrativo Laboral y su relación con la Tutela Jurisdiccional Efectiva

Abstract
El presente trabajo de investigación tiene como objetivo determinar si la actuación de la actividad probatoria escrita por parte de los operadores jurídicos en el proceso contencioso administrativo laboral vulnera significativamente el derecho a la tutela jurisdiccional efectiva de los expedientes vistos en el segundo y quinto juzgado especializado laboral de la Corte Superior de Justicia de La Libertad durante los años 2015 al 2018, demostrándose que la prueba es operada de manera impropia generando como consecuencia extensos plazos para emitir sentencia en los procesos. Del análisis de los 40 procesos contenciosos administrativos laborales, en el 72% la actividad probatoria se limitó solo a las actuaciones del procedimiento administrativo previo; en el 25 % durante la fase procesal el juez ordenó la actuación de medios probatorios adicionales (pruebas de oficio) y; en ninguno de los procesos durante la fase procesal se presentaron excepcionalmente medios probatorios extemporáneos. Concluyendo que la actividad probatoria escrita en el proceso contencioso administrativo laboral vulnera significativamente el derecho a la tutela jurisdiccional efectiva, porque los operadores jurídicos actúan de manera impropia en la actuación de la prueba, generando extensos plazos para emitir sentencia en los procesos, demostrando que en la mayoría de los procesos prevalece la función solo de revisión.
ABSTRAC The objective of this research work is to determine if the performance of the written evidentiary activity by the legal operators in the contentious administrative labor process significantly violates the right to effective jurisdictional protection of the files seen in the second and fifth specialized labor court. of the Superior Court of Justice of La Libertad during the years 2015 to 2018, demonstrating that the test is operated in an improper manner, showing as a consequence long terms to issue a sentence in the processes. From the analysis of the 40 contentious administrative labor processes, in 72% the evidentiary activity was limited only to the actions of the previous administrative procedure; in 25% during the procedural phase, the judge rules out the use of additional evidence (ex officio evidence) and; in none of the processes during the procedural phase was untimely evidence exceptionally presented. Concluding that the written evidentiary activity in the contentious administrative labor process significantly violates the right to effective jurisdictional protection, because the legal operators act improperly in the performance of the evidence, showing extensive terms to issue a sentence in the processes, demonstrating that in review-only function prevails in most processes.
