| dc.description.abstract | El presente trabajo de investigación titulado “Deficiencias probatorias y su influencia en el delito de acoso sexual, distrito judicial de Piura, 2022”, está orientado a determinar las deficiencias probatorias, dadas al condenar con una prueba pericial psicológica con base científica débil y debatible; con la sola declaración de la víctima, cuando no cumple con las garantías de certeza del acuerdo plenario N°2-2005/CJ-116, en particular cuando se trata de delitos que se desarrollan en un ámbito íntimo, clandestino sin indicios o huellas materiales, siendo difícil la verosimilitud; y con pruebas documentales electrónicas cuya integridad deberá definirse conforme una pericia o soporte técnico que constaten que su contenido no ha sido manipulado en especial cuando se tratan de mensajes que provienen de redes sociales. Metodológicamente, la presente investigación se enmarca dentro del tipo no experimental, cualitativo y su diseño es de tipo correlacional causal. Para la realización se ha utilizado dos instrumentos que permitieron recoger información: la guía de entrevista aplicada en el distrito judicial de Piura a trabajadores del poder judicial, trabajadores del ministerio público, abogados penalistas y psicólogos; del mismo modo la guía de observación, orientada al análisis de los casos prácticos N° 00958-2019, el caso N° 01328-2018 y el caso N°286-2010 y finalmente el expediente N°00200-2018-0-1501-JR-CI-01. Los resultados nos han permitido analizar que la incorporación del examen del polígrafo como medio de prueba técnico científico en el proceso penal de acoso sexual puede contribuir a disminuir las deficiencias ya mencionadas y a mejorar el sistema médico legal forense. | |
| dc.description.abstract | ABSTRACT This research work entitled "Evidence deficiencies and their influence on the crime of sexual harassment, judicial district of Piura, 2022", is aimed at determining the evidentiary deficiencies, given when sentencing with a psychological expert evidence with a weak and debatable scientific basis; with the sole declaration of the victim, when it does not comply with the guarantees of certainty of the plenary agreement No. 2-2005/CJ-116, particularly when it comes to crimes that take place in an intimate, clandestine environment without evidence or material traces , being difficult the verisimilitude; and with electronic documentary evidence whose integrity must be defined according to an expertise or technical support that verify that its content has not been manipulated, especially when dealing with messages that come from social networks. Methodologically, the present investigation is framed within the non-experimental, qualitative type and its design is of a causal correlational type. To carry it out, two instruments have been used that allowed information to be collected: the interview guide applied in the judicial district of Piura to workers of the judiciary, workers of the public ministry, criminal lawyers and sychologists; in the same way the observation guide, oriented to the analysis of the case No. 01328-2018 and case No. 286-2010 and finally file No. 00200-2018-0-1501-JR-CI-01. The results have allowed us to analyze that the incorporation of the polygraph examination as a means of technical-scientific evidence in the criminal process of sexual harassment can contribute to reducing the deficiencies already mentioned and to improve the forensic legal system. | |
