El derecho al debido proceso y la nulidad del procedimiento administrativo disciplinario en el marco de la ley del servicio civil

Abstract
El presente trabajo de investigación pretende evidenciar los problemas del Procedimiento Administrativo Disciplinario que contiene la Ley del Servicio Civil – Ley N° 30057, pues en la actualidad los mencionados procedimientos han recaído en nulidades que atentan contra las garantías del derecho al debido proceso, expresado en el ámbito del derecho administrativo como el debido procedimiento. En ese sentido, la realidad problemática aborda sobre el problema elegido materia de investigación el cual es determinar causas y efectos de la vulneración de las garantías del debido proceso y su incidencia y las nulidades del procedimiento administrativo disciplinario, por lo que solamente hemos elegido una problemática específica de los tantos que adolece el procedimiento disciplinario actual. Siendo así, es que este trabajo tiene como base 4 partes teóricas, las cuales están encaminadas a contribuir al sistema jurídico peruano en el ámbito del derecho administrativo disciplinario. En primer término, debemos señalar el Ius Puniendi de la Administración Pública para con sus servidores y la instauración de PADs y las sanciones
correspondientes. Por otro lado, es necesario dar una vista general al Procedimiento Administrativo Disciplinario, por lo que describiremos en que consiste el PAD en el marco de la Ley del Servicio Civil. Asimismo, en la tercera parte hemos realizado un estudio de la garantía del debido proceso que se aplican al ámbito del derecho administrativo teniendo como resultado el debido procedimiento administrativo disciplinario y, finalmente, el tema de la Nulidad en el ámbito administrativo, como consecuencia del no respetar las garantías del debido proceso.
ABSTRACT This research work aims to show the problems of the Administrative Disciplinary Procedure contained in the Civil Service Law - Law No. 30057, since at present the aforementioned procedures have resulted in nullities that violate the guarantees of the right to due process, expressed in the field of administrative law as due procedure. In this sense, the problematic reality addresses the problem chosen as the subject of investigation, which is to determine causes and effects of the violation of the guarantees of due process and its incidence and the nullities of the disciplinary administrative procedure, for which we have only chosen one problem specific of the many that the current disciplinary procedure suffers. Therefore, this work is based on 4 theoretical parts, which are aimed at contributing to the Peruvian legal system in the field of disciplinary administrative law. In the first place we must point out the Ius Puniendi of the Public Administration towards its servants and the institution of PADs and the corresponding sanctions. On the other hand, it is necessary to give a general view of the Administrative Disciplinary Procedure, so we will describe what the PAD consists of within the framework of the Civil Service Law. Likewise, in the third part we have carried out a study of the guarantees of due process that apply to the field of administrative law, resulting in due disciplinary administrative procedure and, finally, the issue of Nullity in the administrative field, as a consequence of the failure to respect the guarantees of due process.
