dc.description.abstractLa investigación fue determinada por la necesidad o no de modificar el inciso 13) del artículo 48°, de la Ley de la Carrera Judicial, el cual regula la falta disciplinaria de los Magistrados del Poder Judicial, por incurrir únicamente en otivación inexistente. Para resolver esta interrogante hicimos uso de la técnica de análisis documental, la misma que nos permitió estudiar porque las quejas contra los jueces son archivadas cuando se plantea queja por cualquier otro vicio de motivación. Así también, se tuvo como instrumento la encuesta compuesta por un cuestionario a jueces y secretarios respecto al tipo de motivación que podría comprenderse como falta muy grave en el artículo 48° inciso 13), de la Ley N°. 29277. Aplicamos los métodos de análisis y síntesis, los mismos que nos permitieron interpretar y discutir los hallazgos, para concluir que si es necesario modificar el inciso 13 del artículo 48 de la Ley N° 29277, pues la idea de no motivar resoluciones judiciales se debe interpretar constitucionalmente, por ello se hace necesario que la normativa proteja otros defectos de motivación como Defectos en la motivación, Insuficiencia en, la motivación y la Motivación constitucionalmente, deficitaria, para un mejor control de la labor judicial.
dc.description.tableofcontentsABSTRACT The investigation was determined by the need or not to modify subparagraph 13) of article 48, of the Judicial Career Law, which regulates the disciplinary offense of the Magistrates of the Judiciary, for incurring only in inexistent motivation. To resolve this question, we used the documentary analysis technique, the same one that allowed us to study why complaints against judges are filed when a complaint is filed for any other motivational defect. Likewise, the instrument was the survey composed of a questionnaire to judges and secretaries regarding the type of motivation that could be understood as a very serious offense in article 48, paragraph 13), of Law No. 29277. We applied the methods of analysis and synthesis, the same ones that allowed us to interpret and discuss the findings, to conclude that if it is necessary to modify subparagraph 13 of article 48 of Law No. 29277, then the idea of not motivating judicial decisions should be interpreted constitutionally, for this reason it is necessary that the regulations protect other motivation defects such as Defects in the motivation, Insufficiency in, the motivation and the Constitutionally, deficient Motivation, for a better control of the judicial work.
