El principio de discrecionalidad administrativa y la vulneración del principio de legalidad

Abstract
Esta investigación titulada “EL PRINCIPIO DE DISCRECIONALIDAD ADMINISTRATIVA Y LA VULNERACIÓN DEL PRINCIPIO DE LEGALIDAD”, está referida a un tema recurrente en las entidades del estado, especialmente en las Municipalidades, en nuestro caso la Municipalidad Distrital de Víctor Larco Herrera, en el bienio 2019-2020, respecto a los servicios que estas brindan a los usuarios, al solicitar los requisitos para adquirir un determinado derecho o servicio de parte de dicha entidad, vemos que estos no se encuentran señalados o prescritos en el TUPA, como lo contempla la norma art. 44.7 ( TUO de Ley 27444- D.S. 004-2019 JUS), concordante con art. 36 .3 de ley 27444 ley del procedimiento administrativo general. De tal forma que se vulnera el principio de legalidad que esta misma Jurisprudencia hace alusión en su artículo IV. 1 de su Título Preliminar.
El TUPA, actualizado debe contener la norma que ha sido derogada o renovada sino fuese así, incurriría en vulnerar el principio de legalidad, que viene hacer la imposición de la norma sobre cualquier acción del poder público. Es decir que todo lo que proviene del Estado debe de arreglo y no por la voluntad individual de una autoridad. Al actuar arbitrariamente los funcionarios de la Municipalidad generan abuso omitiendo o incrementando requisitos que no lo señala la norma actual, obligando al usuario a cumplir no que no debe, debido a la desinformación a través de la norma.
La metodología de investigación usada es la cuantitativa, correlacional, midiendo la relación existente entre la variable vulneración del principio de legalidad y la desinformación del usuario en un proceso administrativo, para luego analizar estas correlaciones y evaluar sus resultados Para ello hemos usado una muestra de: 80 unidades de análisis, distribuidas en 40 expedientes tramitados, 05 Gerentes Administrativos, 10 asesores legales, 05 Magistrados, 20 Abogados; los cuales representan la parte significativa y representativa de la población. Arribándose a la conclusión que si existe una vulneración al principio de legalidad al no publicar la norma en el TUPA de la Municipalidad.
This investigation entitled "THE PRINCIPLE OF ADMINISTRATIVE DISCRETION AND THE VIOLATION OF THE PRINCIPLE OF LEGALITY", refers to a recurring theme in state entities, especially in Municipalities, regarding the services they provide to users, when requesting the requirements to acquire a certain right or service from said entity, we see that these are not indicated or prescribed in the TUPA, as contemplated by the art. 44.7 (TUO of Law 27444- D.S. 004-2019 JUS), consistent with art. 36 .3 of law 27444 law of the general administrative procedure. The TUPA, updated, must contain the norm that has been repealed or renewed, otherwise it would incur in violating the principle of legality, which comes to impose the norm on any action of the public power. That is to say that everything that comes from the State must be arranged and not by the individual will of an authority. By acting arbitrarily, the officials of the Municipality generate abuse by omitting or increasing requirements that are not indicated in the current norm, forcing the user to comply with what they should not, due to misinformation through the norm. The research methodology used is quantitative, correlational, measuring the relationship between the variable violation of the principle of legality and the misinformation of the user in an administrative process, to later analyze these correlations and evaluate their results. For this we have used a sample of: 80 units of analysis, distributed in 40 files processed, 05 Administrative Managers, 10 legal advisors, 05 Magistrates, 20 Lawyers; which represent the significant and representative part of the population. Arriving at the conclusion that if there is a violation of the principle of legality by not publishing the norm in the TUPA of the Municipality.
