dc.descriptionABSTRACT The purpose of the investigation was to determine if the obligation to cover the damages of the occupants of uninsured vehicles, contained in Article 17 of Supreme Decree No. 024-2002-MTC -National Liability Regulations and Mandatory Insurance for Traffic Accidents, is compatible with the principle of joint and several liability set forth in Article 1183 ° of the Peruvian Civil Code. To develop this question, we applied methods such as inductive, deductive and synthesis, in the analysis of the INDECOPI resolutions where it was decided to impose the obligation to cover the damages of the occupants of uninsured vehicles and in which this was not applied. measure, also contrastando the study with the interpretation of article 1183 ° of the Peruvian civil code, arriving to conclude that the obligation to cover the damages of the occupants of uninsured vehicles, provided in the National Regulation of Civil Liability and Compulsory Insurance for Accidents of Transit, is not compatible with the principle of joint and several liability set forth in article 1183 of the civil code, because the law can not be used to enforce or impose joint and several liability in cases that are not or should not be protected by the law. norm, this would generate a normative nonsense of the insurance of the vehicles and therefore save oducts to benefit those who break the law.es_PE
dc.description.abstractRESUMEN El objeto de la investigación fue determinar si la obligación de cubrir los daños de los ocupantes de vehículos no asegurados, contenida en el artículo 17° del Decreto Supremo Nº 024-2002-MTC -Reglamento Nacional de Responsabilidad Civil y Seguros Obligatorios por Accidentes de Tránsito, es compatible con el principio de responsabilidad solidaria prevista en el artículo 1183° del código civil peruano. Para desarrollar esta cuestión, se aplicó métodos tales como el inductivo, deductivo y síntesis, en el análisis de las resoluciones de INDECOPI donde se resolvió imponer la obligación de cubrir los daños de los ocupantes de vehículos no asegurados y en las que no se aplicó esta medida, asimismo contrastando el estudio con la interpretación del artículo 1183° del código civil peruano, llegando a concluir que La obligación de cubrir los daños de los ocupantes de vehículos no asegurados, previsto en el Reglamento Nacional de Responsabilidad Civil y Seguros Obligatorios por Accidentes de Tránsito, no es compatible con el principio de responsabilidad solidaria prevista en el artículo 1183° del código civil, en razón en que no se puede utilizar la ley para obligar o imponer la responsabilidad solidaria en supuestos que no están o no deben estar protegidos por la norma, esto generaría un despropósito normativo del aseguramiento de los vehículos y por ende dar salvoconductos para beneficiar a quienes incumplen con la ley.es_PE
