Abstract
El avance de la medicina exige establecer marcos legales que salvaguarden la dignidad y la autonomía de las personas en el tramo final de sus vidas, evitando la prolongación innecesaria del sufrimiento y la aceleración del proceso de muerte. Esta investigación se centra en la regulación de la ortotanasia a través de una ley de voluntad anticipada, que permita a las personas rechazar tratamientos médicos destinados a prolongar su vida en situaciones terminales causadas por una enfermedad o por un accidente, preservando así su dignidad y autonomía hasta el último momento de sus vidas. En Perú, la ausencia de una regulación clara deja a las personas en una posición vulnerable ante situaciones de terminales por causa de una enfermedad o un accidente. La falta de una guía legal específica podría exponerlas a decisiones médicas no deseadas en circunstancias críticas. Por tanto, implementar una ley de voluntad anticipada se vuelve crucial para garantizar que cualquier persona con capacidad legal pueda expresar sus deseos anticipadamente y asegurar que sean respetados aun cuando no pueda manifestar su voluntad por sí mismo. La investigación propone una ley de voluntad anticipada que permita aplicar la ortotanasia, basándose en un análisis exhaustivo de los derechos fundamentales y en la legislación comparada.
ABSTRACT The advancement of medicine demands the establishment of legal frameworks that safeguard the dignity and autonomy of individuals in the final stages of their lives, avoiding both the unnecessary prolongation of suffering and the acceleration of the dying process. This research focuses on the regulation of orthothanasia through an advance directive law, allowing individuals to refuse medical treatments intended to prolong their lives in terminal situations caused by illness or accident, thus preserving their dignity and autonomy until the very end. In Peru, the lack of clear regulation leaves individuals vulnerable in terminal situations due to illness or accident. The absence of specific legal guidance could expose them to unwanted medical decisions in critical circumstances. Therefore, implementing an advance directive law becomes crucial to ensure that any legally capable person can express their wishes in advance and guarantee that they are respected even when they cannot manifest their will themselves. The research proposes an advance directive law that allows for the application of orthothanasia, based on a thorough analysis of fundamental rights and comparative legislation.
