Abstract
La violencia familiar es un patrón de comportamiento coercitivo en el que una persona ejerce control sobre otra, pudiendo causarle daños físicos, emocionales y económicos. En base a ello, en el Perú se promulgó la Ley N°30364 (D.S.004-2020-MIMP), la cual tiene como finalidad reducir los índices de violencia ejercidos en el entorno familiar, asimismo, se encarga de brindar protección a las víctimas estableciendo las medidas de protección correspondientes a su situación, pudiendo ser esta de riesgo leve, moderado o severo. Dentro de estos parámetros mencionado, cabe resaltar que el objetivo principal es salvaguardar la vida de las víctimas y velar por el respeto y cumplimiento de sus derechos fundamentales, pese a ello, en la presente tesis se ha podido observar las deficiencias a las cuales se ven sometidas las personas agraviadas por parte de los organismos estatales encargados de su protección. Finalmente, se propone en esta minuciosa investigación una serie de reformas legislativas que coadyuven a una aplicación más eficiente de esta Ley, a fin de poder dotar de mejores herramientas a los operadores jurídicos para evitar que se acumulen las cargas procesales, así como, aumentar la logística y capacitar de mejor modo al personal encargado de realizar el seguimiento de las “medidas de protección” con el propósito de que la “Ley N° 30364” sea una norma sin incidencia práctica.
ABSTRACT Family violence is a pattern of coercive behavior in which one person exerts control over another, potentially causing physical, emotional, and economic harm. Based on this, Law No. 30364 (D.S.004-2020-MIMP) was enacted in Peru, aimed at reducing the rates of violence within the family environment. It also aims to provide protection to victims by establishing corresponding protective measures based on their situation, which can be e aforementioned parameters, it is worth noting that the main objective is to safeguard the lives of the victims and ensure respect for and compliance with their fundamental rights. However, this thesis has observed the deficiencies to which aggrieved individuals are subjected by the state agencies responsible for their protection. Finally, this thorough investigation proposes a series of legislative reforms to contribute to a more efficient implementation of this law. This is in order to provide legal operators with better tools to prevent the accumulation of procedural burdens, as well as to enhance logistics and better train personnel responsible for monitoring "protective measures" to ensure that Law No. 30364 becomes a norm with practical impact.
