Abstract
El presente estudio pretende establecer de qué forma regular la fecundación post mortem permite determinar en el ordenamiento jurídico, la filiación del nacido. Se empleó el tipo básica, diseño no experimental, en donde los sujetos participantes fueron material doctrinario, normativo y jurisprudencial, aplicándose la técnica de recojo de datos llamada análisis documental. La conclusión fue que, la regulación de la fecundación post mortem (FPM) permite determinar la filiación del nacido en el ordenamiento, toda vez que, contendrá los alcances, requisitos y efectos jurídicos sobre la materia, entre ellos, la exigencia expresa del consentimiento del causante, la determinación de la forma de prestación y el tiempo para el empleo de la técnica, lo que brindará una garantía real de los derechos esenciales de los individuos que toman la determinación de optar por esta clase de técnicas y de los concebidos en relación con sus derechos filiatorios y sucesorios.

The conclusion was that the regulation of post-mortem insemination allows determining the filiation of the born in the system, since it will contain the scope, requirements and legal effects on the matter, among them, the express requirement of the consent of the deceased, the determination of the form of provision and the time for the use of the technique, which will provide a real guarantee of the essential rights of the individuals who make the decision to opt for this type of techniques and those conceived in relation to their filiatory rights. and inheritance.
