Abstract
RESUMEN
El p
ropósito de la presente investigación fue identificar los Derechos Fundamentales
que se vulneran con el actual sistema de acceso al agua en los A.H. de Nuevo Chimbote,
analizar el sistema de acceso al agua en Nuevo Chimbote, estudiar la naturaleza jurídica
del Derecho Fundamental al Acceso al Agua y analizar las consecuencias que trae la
falta de acceso al agua, para lo cual se utilizó el tipo de investigación descriptiva, de
diseño no experimental, tomando como población a los Asentamientos Humanos del
Dis trito de Nuevo Chimbote, así como los cuadros estadísticos proporcionados por el
INEI y como muestra al Asentamiento Humano Tierra Prometida de Nuevo Chimbote,
como técnica se utilizó la encuesta y como instrumento el cuestionario, los resultados
obtenidos fueron relacionados a la forma cantidad de personas que no cuentan con
servicio de agua potable en sus domicilios, asimismo a la forma cómo estos se
abastecen de agua, habiendo podido evidenciar que los mismos se abastecían
directamente de camiones cister nas que llegan hasta sus domicilios para venderles el
servicio, lo cual genera una desigualdad entre los moradores de un mismo distrito,
puesto que se clasificarían en personas con acceso al agua y con las que no pueden
beneficiarse de dicho servicio y tam bién ocasionan problemas de salud, puesto que
consumen agua no apta para el consumo humano. Las conclusiones a las que se llegaron
fueron que d iversos pronunciamientos internacionales consideran que el acceso al agua
es un derecho humano, es así que el Per ú ha adecuado su normatividad y estableció que
el Acceso al Agua es un Derecho Fundamental del ser humano, asimismo, e l A.H. Tierra
Prometida, carece de servicio de agua potable, teniendo como única opción la de
comprarla a los camiones cisterna, los cuale s no tienen la calidad de apta para el
consumo humano, el Derecho Fundamental a la Igualdad se ve vulnerado por cuando en
un mismo radio urbano existen dos tipos de personas clasificados en quienes tienen
agua, por tuberías de la red principal, y los que n o tienen agua en sus domicilios, hecho
que genera una brecha social entre las personas, en el caso del A.H. Tierra prometida,
existe una violación directa al derecho fundamental de acceso al agua sobre sus
elementos de calidad y cantidad del recursos, hech o ocasionado por el desinterés del
Estado en dotar de dicho recurso a los moradores.

ABSTRACT
The purpose of the present investigation was to demonstrate the identification of
Fundamen tal Rights that are violated with the current system of access to water in the
A.H. de Nuevo Chimbote, analyze the water access system in Nuevo Chimbote, study
the legal nature of the Fundamental Right to Access to Water and analyze the
consequences that l ack of access to water brings, for which the type of descriptive
research was used, of non experimental design, taking as a population the Human
Settlements of the District of Nuevo Chimbote, as well as the statistical tables provided
by the INEI and as a sample to the Human Settlement Tierra Prometida de Nuevo
Chimbote, as a technique the survey was used and as an instrument the questionnaire ,
the results obtained were related to the number of people who do not have potable water
service in their homes, a s well as the way they are supplied with water, having been able
to show that they were supplied directly from tanker trucks that reach their homes to sell
the service, which generates inequality among the residents of the same district, since
they would b e classified as people with access to water and with those who can not
benefit from this service and also cause health problems, since they consume water that
is not suitable for human consumption. The conclusions reached were that various
international pr onouncements consider that access to water is a human right, so that
Peru has adapted its regulations and established that access to water is a fundamental
right of the human being, likewise, the AH Promised Land, lacks potable water service,
having as sol e option to buy it from tankers, which do not have the quality of suitable
for human consumption, the Fundamental Right to Equality is violated by when in the
same radio urban there are two types of people classified in those who have water, by
pipes of th e main network, and those who do not have water in their homes, a fact that
generates a social gap between people, in the case of AH Promised land, there is a direct
violation of the fundamental right of access to water over its elements of quality and
qua ntity of resources, a fact caused by the lack of interest of the State in providing this
resource to the inhabitants.
