Abstract
El Estado peruano y su ordenamiento jurídico regula el contrato de arrendamiento, por el cual se
establece responsabilidades del arrendador y arrendatario financiero, frente a terceros en accidentes
de tránsito. Entendiéndose, en la presente investigación, que el bien de arrendamiento es un vehículo
automotor.
La presente investigación estableció la responsabilidad solidaria del arrendador financiero, frente a
los daños ocasionados por el uso del bien, debido a que es un deber jurídico exigible por el tercero
afectado frente a accidentes de tránsito. Asimismo, la diversa legislación, doctrina, jurisprudencia
nacional y extranjera investigada, establece posiciones en las que señala una responsabilidad
solidaria del arrendador financiero frente a terceros en accidentes de tránsito, en tanto otros países
privilegian la autonomía privada de los contratos señalando como único responsable al arrendatario
financiero.
El presente trabajo de investigación, permitió describir los criterios que se deben tener en cuenta para
establecer la dogmática a estudiar, a través del método dogmático, asimismo se aplicó el método
exegético a fin de identificar y describir los criterios que se deben tener en cuenta para afirmar la
posición de jueces que sustentan, que el arrendador financiero debe responder solidariamente por
accidentes derivados de contrato de arrendamiento financiero, y el método argumentativo que me
permitió fundamentar la hipótesis en base a la normativa y doctrina nacional.
Después de analizar la jurisprudencia, se demostró que, en nuestro país no existe un criterio uniforme,
en cuanto a las sentencias emitidas por los órganos jurisdiccionales. Entonces, considero que se
debería modificar la normativa con relación a la Ley N°27181 Ley General de Transporte y Tránsito
Terrestre, a fin de establecer la responsabilidad solidaria del arrendador financiero, frente a terceros,
víctimas de accidentes de tránsito.
In our country, the financial leasing contract establishes responsibilities of the lessor and the financial lessee in the face of third parties in traffic accidents, as long as the movable asset leased is a motor vehicle. The present paper searches for establish the joint and several liability of the financial lessor against the damages caused by the use of the movable asset, because it is a legal duty required by the third party affected in the face of traffic accidents. Likewise, the diverse legislation, doctrine and national and foreign jurisprudence investigated establishes positions that indicate the joint liability of the financial lessor to third parties in traffic accidents, while other countries privilege the private autonomy of contracts, pointing as sole responsible to the financial lessee. This research paper allows describing the criteria that must be taken into account to establish the dogmatic also in order to describe the criteria that must be taken into account to deny the position of judges who argue that the lessor should respond jointly and severally for accidents or not. derivatives of the financial lease contract, and the argumentative method that allowed me to base the hypothesis with laws, national doctrine.
