Necesidad de modificar el artículo 54° de la Ley 29783 para la incorporación de accidentes in itinere en el Perú

Abstract
El presente trabajo de investigación pretende innovar nuestra legislación peruana,incorporando la figura del accidente in itinere. Al respecto, hemos desarrollado lo quecorresponde a nuestra realidad nacional y los accidentes de trabajo, para que, de esa manera,podamos explicar el vacío que encontraríamos ante el supuesto de un accidente que se sitúeen el trayecto del centro de trabajo al domicilio del trabajador o viceversa. Nos inclinamos a realizar un estudio práctico que ayude a regular la figura del accidente in itinere en la legislación peruana, modificando el artículo 54° de la Ley Nro. 29783, para lo cual hemos analizado jurisprudencia nacional en la que se observa que, los magistrados utilizan las figuras de “accidentes de trabajo” y “accidentes de tránsito” en el análisis jurisprudencial de sus sentencias para referirse –en hechos- a la configuración de un accidente in itinere. A lo largo de la investigación, nos hemos encargado de definir no solo los conceptos que abarcan –de manera general- los accidentes de trabajo, sino que, hemos procurado enmarcar cada aspecto y parámetro que ayuden a determinar cuando estamos ante un accidente in itinere, y la necesidad de la modificación que se pretende realizar en la legislación para su incorporación.
ABSTRACT The present research work intends to innovate our Peruvian legislation, incorporating the figure of the accident in itinere. In this regard, we have developed what corresponds to our national reality and work accidents, so that, in this way, we can explain the gap that we would find in the case of an accident that is located on the way from the workplace to the worker's home or vice versa. We are inclined to carry out a practical study to help regulate the figure of the accident in itinere in the Peruvian legislation, modifying article 54° of Law No. 29783,for which we have analyzed national jurisprudence in which it is observed that, the magistrates use the figures of "work accidents" and "traffic accidents" in the jurisprudential analysis of their sentences to refer -in fact- to the configuration of an accident in itinere. Throughout the research, we have been in charge of defining not only the concepts that cover -in a general way- work accidents, but we have also tried to frame each aspect and parameter that help to determine when we are in front of an accident in itinere, and the need of the modification that is intended to be made in the legislation for its incorporation.
