Esta investigación se dividió en tres capítulos, en el primero se desarrolló la introducción y el marco teórico; en el segundo, se desarrolló el marco metodológico, que sustentó el tipo de investigación realizado, así como los métodos, técnicas e instrumentos utilizados; y en el tercero, se consignó los hallazgos encontrados con su respectiva discusión, conclusiones y recomendaciones. Consecuentemente, la investigación concluyó que, ante el incumplimiento de la medida de protección de no agresión hacia la víctima, bajo apercibimiento expreso, debe aplicarse la agravante del 3er párrafo del Art. 368 del CP sobre Desobediencia a la autoridad en concurso ideal con la agravante del inciso 6 del art. 122-B del CP, sobre Agresiones contra las mujeres o integrantes del grupo famABSTRACT This thesis aims to determine whether the aggravating circumstance of the third paragraph of Art. 368 of the CP on Disobedience to authority is applicable in the event of non-compliance with the protection measure of non-aggression to the victim when there is an express warning, in ideal conjunction with the aggravating circumstance of inc. 6 of Art. 122-B of the CP, on Attacks against women or members of the family group.
