Honores Yglesias, Carlos AntonioGrados Prado, Katherine Margarita12/20/202312/20/20232021https://hdl.handle.net/20.500.14414/20231La presente investigación tiene un enfoque cualitativo y nivel explicativo, su principal objetivo es demostrar la ineficacia de la Ley N.º 30407 en relación a la protección de los animales domésticos del departamento de La Libertad durante el periodo 2018-2019, y hallar las causales explicativas a dicho problema, entre los objetivos específicos se plantearon los siguientes: identificar las deficiencias en la redacción de la Ley 30407-Ley de Protección y Bienestar Animal y sus contradicciones con otras normativas referidas a los animales, establecer las similitudes, y contradicciones entre la normativa nacional e internacional referida a la protección animal, conocer la opinión de abogados penalistas respecto al actuar de las autoridades judiciales en la sanción de los delitos de abandono y crueldad animal contra los animales domésticos, y los principales factores que influyen en su actuar, describir el grado de conocimiento de la población sobre la existencia de la Ley 30407 y sobre su eficacia en la protección de los animales domésticos del departamento de La Libertad y, finalmente, analizar la sentencia recaída en el expediente judicial N.º 190-2018-00-1614-JR-PE-01 de la Fiscalía Mixta Corporativa Provincial de Pacasmayo. Los resultados de esta investigación y las discusiones son resultado del análisis de la normativa legal vigente nacional e internacional, la revisión de la estadística de casos sobre abandono y crueldad animal en el departamento de La Libertad durante el periodo 2018-2019, la aplicación de guías de entrevistas y guías de encuestas; así como del análisis de la sentencia recaída en el expediente judicial N.º 190-2018-00-1614-JR-PE-01 sobre actos de crueldad animal. Finalmente, se concluye que es preciso resaltar la importancia de esta tesis, la misma que por su contenido teórico y datos reales, constituye un buen aporte a nuevas investigaciones.ABSTRACT This research has a qualitative approach and explanatory level, its main objective is to demonstrate the ineffectiveness of Law No. 30407 in relation to the protection of domestic animals in the department of La Libertad during the period 2018-2019, and find the causes explanatory to said problem, among the specific objectives the following were raised: identify the deficiencies in the drafting of Law 30407-Animal Protection and Welfare Law and its contradictions with other regulations referring to animals, establish the similarities and contradictions between the national and international regulations regarding animal protection, know the opinion of criminal lawyers regarding the actions of judicial authorities in sanctioning crimes of abandonment and animal cruelty against domestic animals, and the main factors that influence their actions, describe the degree of knowledge of the population about the existence of Law 30407 and its efficiency in the protection of domestic animals in the department of La Libertad and, finally, analyze the sentence passed in the judicial file No. 190-2018-00-1614-JR-PE-01 of the Pacasmayo Provincial Joint Prosecutor's Office. The results of this research and the discussions are the result of the analysis of the current national and international legal regulations, the review of the statistics of cases on abandonment and animal cruelty in the department of La Libertad during the period 2018-2019, the application of guidelines of interviews and survey guides; as well as the analysis of the sentence passed in the judicial file No. 190-2018-00-1614-JR-PE-01 on acts of animal cruelty.
