The study was conducted by reviewing Comparative Law, making an analysis of Argentine, Colombian and Spanish legislations, in order to obtain a theoretical-practical model of a family protocol. The results obtained were that in all the legislations analyzed, the contractual terms used mainly correspond to the corporate and inheritance law, with its various nuances; and it is concluded that the contractual terms in the national legal order must be mainly corporate and inheritance, giving the reader a model that will allow you to have the legal basis for the development of contractual terms in family protocols in Peru.RESUMEN El presente trabajo de investigación tuvo como objetivo general demostrar que los términos contractuales que debería tener un protocolo familiar en el sistema jurídico peruano vigente son societarios y de sucesión. El estudio se realizó revisando el Derecho Comparado, haciendo un análisis de las legislaciones argentina, colombiana y española., con el fin de obtener un modelo teórico-práctico de un protocolo familiar.
