To carry out this study, topics such as imprudent crimes, the expertise of traffic accidents, culpable homicide, and above all the objective imputation regarding the role or conduct of the victim were analyzed. To test our hypothesis that the role of the victim has had an impact on the sentences for culpable homicide in Trujillo in the period 2016-2017, we had as an instrument the interview with magistrates, and the analysis of cases, consisting of sentences Due to culpable homicide in Trujillo in the 2016-2017 period, methods such as analytical, synthetic, deductive and inductive were applied, leading to the conclusion that the assessment of Police Traffic Accident has affected the role of the victim in the acquittal of those accused of culpable homicide in Trujillo in the 2016-2017 period, because in cases where it is stated that the victim was a contributory factor of the crime, this is explained by the fact that it was the victim who created or increased the risk not allowed and therefore, the result can not be attributed objectively to the defendant, however in some cases the judge guided by the police took as sole criterion the agent assigned as a determining factor of the fact, opted for sentence condemnatory, without analyzing that the accident could be triggered, because the victim acting in a negligent or reckless manner, infringed his role of self-defense or self-protection.La presente investigación tuvo por objeto el análisis de la repercusión del rol de la víctima, en la valoración de la Pericia policial de Accidentes de Tránsito en las sentencias por homicidio culposo en Trujillo en el periodo 2016-2017. Para realizar este estudio se analizó tópicos como los Delitos Imprudentes, la Pericia de Accidentes de Tránsito, Homicidio Culposo, y sobre todo la Imputación objetiva en cuanto al rol o conducta de la víctima. Para contrastar nuestra hipótesis, en cuándo el rol de la víctima si ha tenido repercusión en las sentencias por Homicidio culposo en Trujillo en el periodo 2016-2017, se tuvo como instrumentos la entrevista a magistrados y el análisis de casos, consistentes en sentencias por homicidio culposo en Trujillo en el periodo 2016-2017, se aplicó para ello, métodos como el analítico, sintético, deductivo e inductivo, llegándose a concluir que la valoración de la Pericia policial de Accidentes de Tránsito ha repercutido respecto del rol de la víctima en la absolución de los procesados por Homicidio Culposos en Trujillo en el periodo 2016- 2017, en casos donde se señala que la víctima fue Factor contributivo del delito, esto se explica por cuanto fue la víctima quien creó o aumentó el riesgo no permitido, y por tanto no se le puede imputar objetivamente el resultado al procesado; sin embargo, en algunos casos el juzgador guiado por las pericias policiales, donde se tomó como único criterio al agente asignado como Factor determinante del hecho, optó por una sentencia condenatoria, sin analizar que al accidente se pudo desencadenar, porque la víctima al actuar en forma negligente o imprudente, infringió su rol de autodefensa o autoprotección.spainfo:eu-repo/semantics/openAccessHomicidio culposoAccidente de trànsitoRol de la victimaPericiainfo:eu-repo/semantics/bachelorThesis
