Abstract
La presente investigación tiene como objetivo demostrar la necesidad de modificar el inciso 1 del artículo IV del Título Preliminar del Código de Protección y Defensa del Consumidor, con la finalidad de incluir a la persona jurídica en todas sus modalidades y ser considerada como consumidor. Para ello ha sido necesario analizar el marco normativo vigente, jurisprudencia, doctrina, así como tambien se realizó el estudio del derecho comparado. Asimismo, se utilizó el método inductivo, método analítico, método istemático, método hermenéutico, así como la técnica de acopio documental y técnica de fichaje bibliográfico, lo cual nos permitirá una correcta interpretación y comprensión para el desarrollo de la presente investigación. Finalmente concluimos que, sí existe la necesidad de modificar el inciso 1 del artículo IV
del referido código toda vez que cualquier persona jurídica sin distinción alguna es susceptible de verse afectado por el fenómeno natural de la asimetría informativa. Por lo que recomendamos se realice la modificatoria señalada.
ABSTRACT The objective of this investigation is to demonstrate the need to modify paragraph 1 of article IV of the Preliminary Title of the Consumer Protection and Defense Code, in order to include the legal entity in all its modalities and be considered as a consumer. For this it has been necessary to analyze the current regulatory framework, jurisprudence, doctrine, as well as the study of comparative law. Likewise, the inductive method, analytical method, systematic method, hermeneutic method, as well as the documentary collection technique and bibliographic recording technique were used, which will allow us a correct interpretation and understanding for the development of this research. Finally, we conclude that there is a need to modify paragraph 1 of article IV of the aforementioned code since any legal entity without any distinction is susceptible to being affected by the natural phenomenon of information asymmetry. Therefore, we recommend that the aforementioned modification be made.
