    Protección del consumidor en el código civil y código de protección y defensa del consumidor frente a las clausulas abusivas en los contratos por adhesión de telefonía fija

    In accordance with the Regulation of the Postgrade School of the National University of Trujillo and also, after having culminated the studies of Master, we present the present titled investigation: " PROTECTION OF THE CONSUMER IN THE CIVIL CODE AND LAW OF THE CONSUMER IN FRONT OF THE CONTRACTS OF ADHESION OF FIXED TELEPHONY", in order to obtaining the Master in Law degree, MENTION IN CIVIL AND COMMERCIAL LAW. The problem that we have outlined in the present investigation is: That way the Civil Code and the Consumer's Law, do they protect the Consumer efficiently in front of the abusive clauses in the contracts for adhesion of fixed telephony.? The formulated hypothesis is: The Civil Code and the Consumer's Law, they don't protect the Consumer efficiently in front of the abusive clauses in the contracts for adhesion of fixed telephony., because they are contracts that are executed massively, they are predetermined and they don't consider in a wide way the consumer's rights. The theoretical mark of the present thesis has divided it in 04 chapters. The first chapter tries on general notions of the contract; the second, on the massive recruiting; the third, on the contract of adhesion and the room, the fourth on the protection measures in our legislation and the fiveth on the protection consumer and the civil code ante law protection consumer againt the contracts of adhesion of fixed telephony. For the investigation, we have used the descriptive, analytic, comparative, hermeneutic and synthetic methods, using as technical, the technique of bibliographical investigation, observation technique, technique of descriptive statistic and technique of the conceptual maps. The contrastation of the hypothesis has allowed us to demonstrate the outlined hypothesis, using the whole material of outlined study.
