Item La afectación del derecho a la no autoincriminación de los procesados en el ejercicio de la función jurisdiccional especial de las rondas campesinas de la provincia de santiago de chuco en los años 2012 - 2013(Universidad Nacional de Trujillo, 2015) Valverde Pompa, Olivia Vanesa; Sánchez Zavaleta, Sergio Gustavo.This thesis was conducted in order to determine the exercise of the special judicial function that the peasant patrols in the province of Santiago de Chuco and significant involvement of the same to the right to self-incrimination that all persons as being investigated during judicial proceedings. To do a comprehensive study of the issue in the case it was conducted in five chapters: The first chapter covers the study of the human being as a dual, "I" and the "world, also including the social and democratic rule of law by adopting today a vision pluralist (the right is created by the state and all social organization regulated legally), so in the second chapter speaks of peasant patrols its history and its various meanings that he has been given until today, principles, achievements and values benefits that come their existence in society. In the third chapter discusses the regulatory framework governing the peasant patrols as has acquired its regulations with the passing of time through various laws, projects and agreements adopted by countries facing the emergence of this group. Added to this the fourth chapter covers about judicial function exercised the peasant patrols and reconnaissance conducted by different legal entities. The fifth chapter includes the test and the right against self-incrimination, the way how they get these groups the various evidence, to come to establish the responsibility of investigating, violating all warranties governing due process and effective judicial protection. The last chapter is framed in a study on the various cases presented in Santiago de Chuco Province and to supplement this paper has analyzed the casuistry to prove infringement by the peasant patrols the right to self-incrimination, finding that this right if it is violated significantly, in the exercise of the judicial function of the peasant patrols of Santiago de Chuco, as these by obtaining selfincrimination in their statements, they are sufficient to support the solutions you arrive in their communal judicial process.
