Abstract
Se desarrolló la investigación considerándose como el objetivo principa, identificar los criterios para establecer al indulto y la conmutación de penas como políticas públicas para disminuir el hacinamiento penitenciario en el Perú, siendo una investigación de gabinete y de campo, cualititativa y cuantitativa a nivel explicativo. La investigación estudió los últimos cinco gobiernos peruanos para analizar el establecimiento de criterios a implementar al utilizar dos mecanismos básicos: indultos y conmutación de penas. La propuesta resultante contempla criterios tanto primarios como secundarios. Los primeros se aplicarían para corregir deficiencias legales, errores o insuficiencias en el sistema jurídico, o cuando otras instancias no han cumplido sus funciones y los criterios secundarios, en cambio, se basan en la autonomía inherente a las gracias presidenciales, evitando recurrir a otros mecanismos legales y destacando la aplicación específica de indultos y conmutación de penas. La investigación sugiere una política pública integral que incorpore los criterios delineados. Esta propuesta busca abordar de manera efectiva el desafío del hacinamiento penitenciario, al tiempo que garantiza la coherencia y eficacia en la aplicación de indultos y conmutaciones de penas.
ABSTRACT The research was carried out with the main objective of identifying criteria for establishing pardon and sentence commutation as public policies to reduce prison overcrowding in Peru. This study was conducted using both qualitative and quantitative methods, including desk research and fieldwork, at an explanatory level. The analysis covered the last five Peruvian governments to examine the establishment of criteria for implementing two fundamental mechanisms: pardons and sentence commutations. The resulting proposal includes both primary and secondary criteria. The former would be applied to correct legal deficiencies, errors, or shortcomings in the judicial system, or when other instances have failed to fulfill their functions. On the other hand, the secondary criteria are based on the inherent autonomy of presidential pardons, avoiding recourse to other legal mechanisms and highlighting the specific application of pardons and sentence commutations. The research suggests a comprehensive public policy that incorporates the outlined criteria. This proposal aims to effectively address the challenge of prison overcrowding while ensuring coherence and efficacy in the pplication of pardons and sentence commutations.
