Abstract
La Defensoría Municipal del Niño y del Adolescente (DEMUNA) es un servicio encargado de proteger y promover los derechos de los niños y adolescentes dentro de la circunscripción municipal, teniendo como funciones específicas, las descritas en el art. 45° del Código de los Niños y Adolescentes. En la provincia de Trujillo, la mayoría de las Municipalidades Distritales cuentan con DEMUNA dentro de su organización administrativa; sin embargo, se encuentra sumido en las áreas de servicios sociales. Dicha situación limita la gestión de las DEMUNA en la provincia de Trujillo por la situación de dependencia administrativa frente a órganos distintos en la prevención y protección real de los derechos fundamentales. En consecuencia, la presente investigación pone énfasis en la necesidad de independizar administrativamente a las oficinas defensoriales, así como asignar y ejecutar presupuesto necesario para que el personal de las DEMUNA en la provincia de Trujillo, cuente con condiciones adecuadas y con la debida capacitación en temas de su competencia con perspectiva de género, enfoque de derechos e interculturalidad a el cumplimiento cabal de sus unciones.
ABSTRACT The Municipal Ombudsman for Children and Adolescents (DEMUNA) is a service in charge of protecting and promoting the rights of children and adolescents within themunicipal district, having as specific functions, those described in art. 45 ° of the Code of Children and Adolescents. In the province of Trujillo, most of the District Municipalities have DEMUNA within their Administrative Organization; however, it is mired in the areas of social services. This situation limits the management of the DEMUNA in the province of Trujillo due to the situation of administrative dependence on different bodies in the prevention and rea protection of fundamental rights. Consequently, this research emphasizes the need to make the defense offices administratively independent, as well as assigning and executing the necessary budget so that DEMUNA personnel in the province of Trujillo have adequate conditions and adequatetraining on issues. of their competence with a gender perspective, a rights approach and interculturality for the full performance of their functions.
