dc.description.abstractLa presente tesis tuvo como principal objetivo determinar la existencia de la vulneración a los derechos de los herederos preteridos en la sucesión intestada en vía notarial en razón a la falta de seguridad jurídica. La realidad problemática que se aborda refiere a la actual demanda que existe respecto a las solicitudes de sucesiones intestadas que responden a una realidad de nuestro país, conllevando tal cultura a la sobrecarga procesal respecto de las sucesiones intestadas tramitadas en la vía judicial; a pesar que, la Ley N° 26662 en su art. 38 habilita la tramitación de la sucesión intestada mediante la vía notarial. Los instrumentos utilizados fueron la entrevista cuya técnica, la guía de preguntas, se identificó conocer de qué manera se vulnera el derecho del heredero preterido en la tramitación de la sucesión intestada en la vía notarial, de igual forma se identificaron los derechos sucesorios vulnerados y la relación de esta vulneración en la legislación peruana. Por último, se propuso una modificación a la ley en el sentido que se incorpore un proceso de inclusión del heredero preterido en la vía notarial a fin de evitar acudir al Poder Judicial mediante el proceso de petición de herencia.
dc.description.abstractABSTRACT The main objective of this thesis was to determine the existence of the violation of the rights of the deceased heirs in the intestate succession through notarial means due to the lack of legal security. The problematic reality that is addressed refers to the current demand that exists regarding requests for intestate successions that respond to a reality of our country, such a culture leading to procedural overload with respect to intestate successions processed through judicial means; Although, Law No. 26662 in its art. 38 enables the processing of intestate succession through notarial means. The instruments used were the interview whose technique, the question guide, identified how the right of the deceased heir is violated in the processing of intestate succession through notarial means, in the same way the violated inheritance rights and the relationship of this violation in Peruvian legislation. Finally, a modification to the law was proposed in the sense that a process for including the deceased heir through the notarial process would be incorporated in order to avoid going to the Judiciary through the inheritance petition process.
