Abstract
La tesis titulada “Creación de juzgados de ejecución penal como mecanismo de eficacia del sistema penitenciario peruano”, se planteó como problema: ¿Cómo la creación de los juzgados de ejecución penal de competencia en solicitudes de beneficios penitenciarios, libertad anticipada, conversión de penas privativas de libertad y revocación de penas suspendidas, permite garantizar la eficacia del sistema penitenciario peruano?, cuya hipótesis fue: La creación de juzgados de ejecución penal; garantiza la eficacia del sistema penitenciario peruano. Siendo el objetivo general: Determinar la procedencia en la creación de juzgados de ejecución penal, como mecanismo de eficacia del sistema penitenciario peruano. Se trabajó con un tipo de estudio descriptivo en el proceso cuantitativo, el diseño fue no experimental - transversal, con una muestra poblacional no probabilística de 42 operadores del derecho. Se aplicó la técnica de observación y la técnica de la encuesta. Los resultados y el análisis de la discusión muestran la factibilidad y la importancia de la creación de los juzgados de ejecución penal, a efectos de poder resolver la problemática surgida desde hace décadas atrás, así lograr el deshacinamiento de lo penales, y la creciente carga procesal, la resolución de las solicitudes de los internos como semilibertad o libertad condicional, como también hacer prevaler el derecho que tiene el sentenciado de la reinserción a la sociedad una vez cumplido su pena.
The thesis entitled "Creation of criminal enforcement courts as a mechanism for the effectiveness of the Peruvian prison system", was raised as a problem: How the creation of criminal enforcement courts of jurisdiction in applications for prison benefits, early release, conversion of custodial sentences of freedom and revocation of suspended sentences, will allow to guarantee the effectiveness of the Peruvian penitentiary system ?, whose hypothesis was: The creation of criminal execution courts; It will guarantee the efficiency of the Peruvian prison system. The general objective being: Determine the origin in the creation of criminal execution courts, as an effective mechanism of the Peruvian prison system. A descriptive type of study was used in the quantitative process, the design was non-experimental - cross-sectional, with a non-probabilistic population sample of 42 legal operators. The observation technique and the survey technique were applied. The results and the analysis of the discussion show the feasibility and importance of the creation of criminal execution courts, in order to be able to resolve the problems that have arisen decades ago, thus achieving the elimination of criminal matters, and the growing procedural burden. , the resolution of the requests of the inmates such as semi-release or conditional freedom, as well as to make prevail the right that the sentenced person has to reintegrate into society once his sentence has been served.
