dc.description.abstractLa presente investigación tiene como fin regular la exoneración de liquidación de devengados en pensiones alimenticias en hijos mayores de edad, ya que al cambiar la representación de la madre al hijo alimentista por su mayoría de edad, el hijo puede solicitar al juzgado que se brinde su liquidación de devengados, y el juzgado brinda la liquidación sin tener en cuenta si sigue con su estado de necesidad o si cumple con los requisitos establecidos en los Artículos 424° y 483° del Código Civil que se le atribuía y que le permitía seguir percibiendo una pensión alimenticia, siendo un abuso del derecho al percibir un monto de liquidación injusta el cual no le correspondía por no cumplir con los requisitos para seguir percibiendo dicha pensión. Por esta razón se tiene como objetivo general “Establecer los presupuestos en los que el Juez deniegue liquidación devengada de alimentos en la etapa de ejecución”. Llegando a la conclusión que es necesario la regulación de la liquidación de devengados en la etapa de ejecución toda vez que el hijo alimentista mayor de edad debe probar que cumple con los presupuestos establecidos por ley con la finalidad que no se vea afectada la Tutela Jurisdicción Efectiva del demandado.
dc.description.abstractABSTRACT The purpose of this investigation is to regulate the exoneration of the liquidation of child support payments for children of legal age, since when the representation of the mother changes to the child who is the provider of support due to his majority, the child can request the court to provide his liquidation of payments, and the court provides the liquidation without taking into account if he continues with his state of need or if he complies with the requirements established in Articles 424° and 483° of the Civil Code that were attributed to him and that allowed him to continue receiving alimony, being an abuse of the right to receive an unfair liquidation amount which did not correspond to him because he did not comply with the requirements to continue receiving such alimony. For this reason, the general objective is to “Establish the assumptions in which the Judge denies the liquidation of the alimony accrued in the execution stage”. Reaching the conclusion that it is necessary to regulate the liquidation of the accrued alimony at the execution stage, since the child who is of legal age must prove that he/she complies with the requirements established by law in order not to affect the effective guardianship and jurisdiction of the defendant.
