Abstract
Esta tesis titulada «El control de convencionalidad frente al precedente vinculante del
tribunal constitucional: hacia una interpretación conforme a la convención americana de derechos humanos y el bloque de convencionalidad» abarca un amplio espectro de temas
relacionados con el control de convencionalidad y su aplicación a los precedentes
vinculantes emitidos por el Tribunal Constitucional. En un contexto en el que la
armonización entre el ordenamiento jurídico interno y los estándares internacionales de derechos humanos es esencial, este trabajo de investigación explora en detalle los fundamentos, alcance y mecanismos de control de convencionalidad.
La primera parte del marco teórico se enfoca en el control de convencionalidad en sí, abordando sus fundamentos generales, específicos y la naturaleza de su aplicación. Se explora la relevancia del efecto útil de las obligaciones internacionales y la prohibición de alegar el derecho interno para incumplir tratados. Además, se analiza la naturaleza del
control como una obligación internacional y su rol como función creadora de derecho, así
como la titularidad y alcance de su ejercicio.
El Tribunal Constitucional es objeto de análisis en la segunda sección, abordando su origen,
rol en el control de poderes del Estado, naturaleza y su papel en el sistema legal peruano. El
tercer segmento se enfoca en los precedentes vinculantes y los posibles riesgos en su
aplicación, incluyendo su evolución histórica y su relevancia en el contexto nacional.
El cuarto apartado examina casos en los que la Corte Interamericana de Derechos Humanos
ha aplicado el control de convencionalidad, proporcionando una visión detallada de los fundamentos y razonamientos legales detrás de estas decisiones. La quinta sección se sumerge en un estudio crítico de la aplicación del control de convencionalidad a un precedente vinculante específico, utilizando como caso de estudio el Expediente Nº 0083-
2015-0-1618-JM-LA-01 en el contexto peruano. Los fundamentos, procedimientos y análisis críticos de este caso son explorados en profundidad.
Finalmente, se aborda la garantía de armonización con estándares internacionales de derechos humanos, presentando fundamentos y proponiendo un procedimiento para el
control de convencionalidad de un precedente vinculante.
This thesis entitled «Conventionality Control in the Face of the Binding Precedent of the Constitutional Court: Toward an Interpretation in Conformity with the American Convention on Human Rights and the Conventionality Block» covers a broad spectrum of issues related to the control of conventionality and its application to binding precedents issued by the Constitutional Court. In a context in which harmonisation between the domestic legal order and international human rights standards is essential, this research explores in detail the foundations, scope and mechanisms of conventionality control. The first part of the theoretical framework focuses on conventionality control itself, addressing its general and specific foundations and the nature of its application. The relevance of the useful effect of international obligations and the prohibition of invoking domestic law to breach treaties is explored. In addition, the nature of control as an international obligation and its role as a law-creating function, as well as the ownership and scope of its exercise, are analysed. The Constitutional Court is analysed in the second section, addressing its origin, its role in the control of State powers, its nature and its role in the Peruvian legal system. The third segment focuses on binding precedents and the possible risks in their application, including their historical evolution and their relevance in the context of the Peruvian legal system. The fourth section examines cases in which the Inter-American Court of Human Rights has applied conventionality control, providing a detailed overview of the legal basis and reasoning behind these decisions. The fifth section dives into a critical study of the application of conventionality control to a specific binding precedent, using as a case study Case No. 0083-2015-0-1618-JM-LA-01 in the Peruvian context. The foundations, procedures and critical analysis of this case are explored in depth. Finally, the guarantee of harmonisation with international human rights standards is addressed, presenting the foundations and proposing a procedure for the conventionality control of a binding precedent.
