Cargas del patrimonio de la sociedad conyugal, a la luz del artículo 316 del Código civil. Propuesta normativa.

| dc.description.abstract | El presente trabajo de investigación tiene como objetivo determinar si debe derogarse el inciso 2 del artículo 316 del Código Civil por generar una carga patrimonial indebida a la sociedad conyugal. Analizaremos en qué medida generaría una carga patrimonial indebida a la sociedad conyugal; si de existir una carga patrimonial este afectaría a los miembros de la sociedad conyugal que dedican todo su esfuerzo y tiempo a la sociedad, al tratarse de hijos extramatrimoniales de uno de los conyugues. En la presente investigación, se llegará a determinar si realmente el inciso 2 del artículo 316 del CC genera carga indebida a la sociedad conyugal y si es necesario que el mismo se derogue, asimismo la investigadora considera necesario precisar en qué casos si debe mantenerse dicha carga a la sociedad conyugal y en qué casos no y formular propuesta normativa, para modificar o variar el texto del inciso 2 del artículo 316 CC. Al concluir esta tesis recomendamos a los legisladores nacionales, especificar mejor la norma y en qué casos se debería aplicar detalladamente porque existe vulneración al derecho patrimonial de la sociedad conyugal. | |
| dc.description.abstract | ABSTRACT The objective of this research work is to determine if subparagraph 2 of article 316 of the CC should be repealed for generating an undue patrimonial burden on the conjugal partnership. We will analyze to what extent it would generate an undue financial burden on the marital partnership; if if there were a matrimonial burden, this would affect the members of this conjugal partnership who planned to dispose of all the effort, dedication and time given to the partnership, we consider for this analysis to be the extramarital children of one of the spouses. For the present investigation, it is possible to determine if lubparagraph 2 of article 316 of the CC really generates an undue burden on the conjugal partnership and if it is necessary for it to be repealed, I also consider that it is necessary to specify in what cases if said should be maintained. charge to the conjugal society and in what cases not and formulate proposals to modify or change subparagraph 2 of article 316. At the conclusion of this thesis we can recommend our legislators to have to better specify this rule and in cases it should be accepted because there is a iolation of the patrimonial right that assists a family. | |
