dc.descriptionABTRACT The research work "The Constitutionality of the existence of the Cajas Municipales de Ahorro y Crédito (CMAC) in the financial intermediation system", deals with the existence of the CMACs owned by the municipalities and the role they play in the sector financial; During the development of the investigation, it is analyzed if the activities carried out by the CMACs fall within the subsidiarity allowed by the State; Its objective is the analysis of the legal nature of the CMACS, the determination of the role it plays in Peruvian society and in the financial system; and its correspondence with the current constitutional order. The investigation starts by analyzing the historical, political, economic context that gave rise to the municipal funds, all the normative bodies that were published after its creation; their growth indicators and the role they have within the financial sector were analyzed, as well as whether the activity carried out by these companies has a subsidiary function and whether it is in accordance with the current constitutional order. The results obtained are that the CMACs are companies of the financial system of private law, owned by the municipalities, whose presence is necessary for the development of the country, due to the promotion of savings and the granting of credit for people part of the financial inclusion, Therefore, apart from being a fundamental part of the financial sector, it is a company whose presence is in accordance with the constitutional order for the social purpose it pursues.es_PE
dc.description.abstractRESUMEN El presente trabajo de investigación “La Constitucionalidad de la existencia de las Cajas Municipales de Ahorro y Crédito (CMAC) en el sistema de intermediación financiera”, trata sobre la existencia de las CMAC de propiedad de las municipalidades y el rol que desempeña actualmente en el sector financiero; durante el desarrollo de la investigación se analizaron temas como si las actividades realizadas por las CMAC, se encuadran dentro de la subsidiariedad permitida por el Estado; teniendo como objetivo el análisis de la naturaleza jurídica de las CMACS, la determinación del rol que viene desempeñando en la sociedad peruana, en el sistema financiero; y su correspondencia con el ordenamiento constitucional vigente. La investigación partió analizando el contexto histórico, político, económico que dio origen a las cajas municipales, todos los cuerpos normativos que se publicaron posterior a su creación; se analizó sus indicadores de crecimiento y el rol que tienen dentro del sector financiero, así como también, se ha examinado si la actividad desarrollada por estas empresas cumplen una función subsidiaria y si ésta es acorde al ordenamiento constitucional vigente. Los resultados obtenidos son que las CMAC son empresas del sistema financiero de derecho privado, de propiedad de las municipalidades, cuya presencia es necesaria para el desarrollo del país, debido al fomento del ahorro y al otorgamiento de crédito para personas parte de la inclusión financiera, por lo que además de ser parte fundamental del sector financiero, es una empresa cuya presencia es acorde al ordenamiento constitucional por el fin social que persigue.es_PE
