dc.description.abstractLa facultad legislativa conferido por la Constitución al congreso de la república permite que éste emita una serie de leyes ordinarias o de rango constitucional o que forman parte del bloque constitucional y dentro de todas ellas, leyes generales o especiales, siempre acordes a lo regulado al artículo 103° de la Constitución del estado. Empero, en diversas oportunidades el poder legislativo haciendo uso de esa atribución, ha emitido normas que modifican temas tributarios, estableciendo una problemática sobre la constitucionalidad y legalidad de dichas modificaciones. Es así que, en muchas oportunidades el congreso ha emitido muchas leyes de índole social, que han generado diversos déficit en la recaudación tributaria nacional o municipal, donde en forma populista se emiten normas que buscan una atención social, tal es el caso de la modificación del artículo 19° de la Ley de Tributación Municipal en la inafectación del impuesto predial sobre las personas adultas mayor, donde la municipalidad no puede recaudar el impuesto predial. En concreto, el tema de estudio busca el responder la pregunta de si los Decretos Legislativos, al tratar temas de carácter tributarios, como son los impuestos; resultan ser una norma válida y que cumplen con lo regulado en los artículos 74° y 103° de la Constitución.
dc.description.abstractABSTRACT The legislative power conferred by the Constitution to the Congress of the Republic allows it to issue a series of ordinary laws or laws of constitutional rank or that are part of the constitutional block and within all of them, general or special laws, always in accordance with the provisions of article 103° of the State Constitution. However, on various occasions the legislative power, making use of this attribution, has issued regulations that modify tax issues, establishing a problem on the constitutionality and legality of said modifications. Thus, on many occasions, Congress has issued many laws of a social nature, which have generated various deficits in national or municipal tax collection, where regulations are issued in a populist manner that seek social attention, such is the case of the modification of article 19 of the Municipal Taxation Law in the unaffectation of the property tax on older adults, where the municipality cannot collect the property tax. Specifically, the subject of study seeks to answer the question of whether the Legislative Decrees, when dealing with tax issues, such as taxes; they turn out to be a valid norm and that they comply with what is regulated in articles 74 and 103 of the Constitution.
