dc.descriptionThe present investigation had the objective of determining the influence of the resolutions of the Ninth Family Court of the Superior Court of Justice of La Libertad and the actions of the procedural parties in the effectiveness of the protection measures issued by said court. To do this, the technique of recording and documentary analysis was used, in addition to the analytical-synthetic, inductive-deductive and exegetical method, in order to analyze twenty (20) files on family violence filed in the Ninth Family Court of the Superior Court of Justice of La Libertad during the year 2020, in which protective measures were issued in favor of the victim and at least one new complaint was added to the file for repeated acts of violence between the parties. The results show that the resolutions of the Ninth Family Court of the Superior Court of Justice of La Libertad and the actions of the procedural parties have a negative influence on the effectiveness of the protection measures issued, while actions or omissions are identified that prevent their main purpose is fulfilled, which is to neutralize or minimize the harmful effects of the violence exerted against the victim.es_PE
dc.description.abstractLa presente investigación tuvo como objetivo el determinar la influencia de las resoluciones del Noveno Juzgado de Familia de la Corte Superior de Justicia de La Libertad y las actuaciones de las partes procesales en la eficacia de las medidas de protección dictadas por dicho juzgado. Para ello, se utilizó la técnica del fichaje y análisis documental, además del método analítico-sintético, inductivo-deductivo y exegético, a fin de analizar veinte (20) expedientes en materia de violencia familiar ingresados al Noveno Juzgado de Familia de la Corte Superior de Justicia de La Libertad durante el año 2020, en los cuales se dictaron medidas de protección a favor de la víctima y se cumuló al expediente por lo menos una nueva denuncia por reiterados hechos de violencia entre las partes. Los resultados demuestran que las resoluciones del Noveno Juzgado de Familia de la Corte Superior de Justicia de La libertad y las actuaciones de las partes procesales influyen de manera negativa en la eficacia de las medidas de protección dictadas, en tanto se identifican acciones u omisiones que impiden se cumpla con la principal finalidad de estas, que es neutralizar o minimizar los efectos nocivos de la violencia ejercida en contra de la víctima.es_PE
