| dc.description.abstract | El presente trabajo de investigación titulado “Libertad contractual en el proceso de ejecución de garantía hipotecaria”, elaborado con el objeto de analizar las ventajas y desventajas de la celebración de venta extrajudicial con propuesta de esquema y que el acreedor pueda optar por la adquisición directa del inmueble en la primera convocatoria mediante la modificación de un artículo del Código Procesal Civil. En primer lugar, porque se ha advertido que los procesos de ejecución de garantía hipotecaria implican dificultades para las partes y la administración de justicia en factores concernientes a tiempo, esfuerzo y costo. Y, en segundo lugar, porque legislaciones como España y Argentina poseen un tratamiento remisivo a un mecanismo extrajudicial alterno al proceso, habiéndose recurrido a los métodos analítico, descriptivo, explicativo y comparativo. Los hallazgos, evidencian la necesidad de regulación normativa de un mecanismo extrajudicial alterno al proceso de ejecución de garantía hipotecaria que otorgue ventajas a las partes y a la administración de justicia, mediante procedimiento de venta extrajudicial en vía notarial y la adquisición directa del inmueble por el acreedor en la primera convocatoria, resultando facultativo para las partes la incorporación de la cláusula en la constitución de garantía hipotecaria en la primera situación. | |
| dc.description.abstract | ABSTRACT The present research work entitled "Contractual freedom in the process of foreclosure of mortgage guarantee", prepared in order to analyze the advantages and disadvantages of the celebration of extrajudicial sale with a scheme proposal and that the creditor can opt for the direct acquisition of the property in the first call by modifying an article of the Civil Procedure Code. In the first place, because it has been noted that the foreclosure processes imply difficulties for the parties and the administration of justice in terms of time, effort and cost. And, secondly, because legislations such as Spain and Argentina have a referral treatment to an alternative extrajudicial mechanism to the process, having resorted to analytical, descriptive, explanatory and comparative methods. The findings show the need for regulatory regulation of an alternative extrajudicial mechanism to the process of foreclosure of the mortgage guarantee that grants advantages to the parties and the administration of justice, through the extrajudicial sale procedure through a notary public and the direct acquisition of the property by the creditor. in the first call, being optional for the parties the incorporation of the clause in the constitution of mortgage guarantee in the first situation. | |
