| dc.description | The present investigation addresses the problematic that revolves around family violence, which is very important in our reality because it has current connotations such as the non-application of the effects of the sentence provided for in the law of protection against violence Family as: are the measures of protection; the treatment; The reparation of the damage and the maintenance pension in a mandatory and concomitant way in their sentences. In the development of the present investigation were used data collection methods and techniques such as: dogmatic method, comparative method, method of analysis - synthesis among others. Likewise, the techniques used as the interview, the survey and the signing were appropriate for the development of the subject under study. The first chapter covers all the general aspects of family violence (definition, classification of violence, types of abuse, protection mechanisms, etc.); The second chapter deals with the stages of the investigation process of family violence, the third chapter deals with the reparation of damages in both National Legislation and Comparative Law, in the fourth chapter we touch on the case study. The results have been expressed in tables and statistical graphs, which will allow us a more didactic explanation of the discussion of results. The conclusions and recommendations cover the objectives of the research developed in such a way as to be relevant and applicable to the existing reality in the field of law | es_PE |
| dc.description.abstract | La presente investigación aborda la problemática que gira en torno a la violencia familiar, la misma que reviste gran importancia en nuestra realidad por tener connotaciones de actualidad como es la no aplicación de los efectos de la sentencia previstos en la ley de protección frente a la violencia familiar como: son las medidas de protección; el tratamiento; la reparación del daño y la pensión de alimentos de manera obligatoria y concomitante en sus sentencias. En el desarrollo de la presente investigación se utilizaron métodos y técnicas de recopilación de datos como: el método dogmático, método comparativo, método de análisis – síntesis entre otros. Así mismo, las técnicas utilizadas como la entrevista, la encuesta y el fichaje fueron las apropiadas para el desarrollo del tema objeto de estudio. En el primer capítulo se desarrolla todo los aspectos generales de la violencia familiar (definición, clasificación de violencia, tipos de maltrato, mecanismos de protección, etc.); el segundo capítulo está referido a las etapas del proceso investigatorio de violencia familiar, el tercer capítulo se desarrolla lo referente a la reparación del daño tanto en la Legislación Nacional como en el Derecho Comparado, en el cuarto capítulo se toca lo referente al caso práctico. Los resultados han sido plasmados en cuadros y gráficos estadísticos, los cuales nos permitirán una explicación más didáctica de la discusión de resultados. Las conclusiones y recomendaciones abarcan los objetivos de la investigación desarrollada de tal manera que resultan pertinentes y de aplicación a la realidad existente en el ámbito del Derecho | es_PE |
