dc.descriptionThe investigation seeks to demonstrate that a modification of article 400 of the Civil Code is necessary, regarding the expiration period to be able to initiate an action to challenge extramarital paternity, since it violates the right to identity. In this sense, it remains in this thesis to propose a solution to the problem, but not any solution within the existing range of legal reality, but the most effective possible solution. Due to this, the thesis is based on the need to solve the conflict in which - in cases where the period for filing the paternity challenge claim has expired - incurs said legal norm (Article 400 of the civil code) contravening to the right to identity, since it establishes an expiration period to challenge the paternity of an extramarital child, limiting the enjoyment of the right to identity, which is related to other rights. Consequently, faced with the problem raised, the solution made by the Supreme Court corresponds to the non-application of the norm through diffuse control; however, it is not the most effective solution; being necessary the modification of lege ferenda of article 400 of the civil code; in order to protect the right to identity.es_PE
dc.description.abstractLa investigación busca demostrar que resulta necesaria una modificación del artículo 400° del Código Civil, en lo que concierne al plazo de caducidad para poder iniciar una acción de impugnación de paternidad extramatrimonial, toda vez que vulnera el derecho a la identidad. En ese sentido, resta en esta tesis proponer una solución al problema, pero no cualquier solución dentro de la ama existente de la realidad jurídica, sino la solución más eficaz posible. En razón a ello, la tesis se sustenta en la necesidad de solucionar el conflicto en que - en los casos donde el plazo de interposición de la demanda de impugnación de paternidad ha caducado - incurre dicha norma legal (Artículo 400° del código civil) contraviniendo al derecho a la identidad, toda vez que establece un plazo de caducidad para impugnar la paternidad de hijo extramatrimonial limitando el goce del derecho a la identidad, que de manera conexa se encuentran vinculados otros derechos. En consecuencia, frente al problema planteado, la solución efectuada por la Corte Suprema corresponde a la inaplicación de la norma a través del control difuso; sin embargo, la misma no es la solución más eficaz; siendo necesaria la modificación de lege ferenda del artículo 400 del código civil; a fin de proteger el derecho a la identidad.es_PE
