Abstract
La presente investigación tuvo como objetivo principal determinar el efecto de la
criminalización del Acoso Sexual en el Perú. Para cumplir con el objetivo expuesto, se
consideró una muestra constituida por las Denuncias por acoso sexual a nivel nacional
realizadas por las agraviadas en las instituciones públicas 2022-2023; por las denuncias
realizadas por Hostigamiento y Acoso Sexual en Instituciones Públicas y Privadas de la
Provincia de Trujillo 2021; por las víctimas que no denunciaron acoso sexual en el año
2021; por los estudiantes de la Universidad Nacional de Trujillo- UNT que sufrieron acoso
sexual en el año 2019; por trabajadores y profesionales en el año 2023; y por la
Jurisprudencia nacional y comparada, complementada con la legislación y doctrina
relacionada con las variables de estudio. Las técnicas utilizadas para recolectar la
información de la muestra de estudio fueron el análisis documental y la encuesta, con sus
respectivos instrumentos de recolección de datos. Asimismo, los métodos empleados para
la discusión de los resultados fueron: el método inductivo, deductivo, analítico, sintético y
hermenéutico. Finalmente, se ha verificado que la criminalización del delito de acoso
sexual ha tenido un efecto mínimo positivo en la población peruana, puesto que muchas
conductas con connotación sexual no son denunciadas por temor a ser despedidos, a las
represalias, vergüenza y por desconocer las vías adecuadas para denunciar.
The main objective of this research was to determine the effect of the criminalization of Sexual Harassment in Peru. To meet the stated objective, a sample was considered consisting of Complaints of sexual harassment at the national level made by the aggrieved in public institutions 2022-2023; for the complaints made about Harassment and Sexual Harassment in Public and Private Institutions in the Province of Trujillo 2021; for victims who did not report sexual harassment in 2021; for the students of the National University of Trujillo- UNT who suffered sexual harassment in 2019; by workers and professionals in the year 2023; and by national and comparative jurisprudence, complemented by legislation and doctrine related to the study variables. The techniques used to collect information from the study sample were documentary analysis and the survey, with their respective data collection instruments. Likewise, the methods used to discuss the results were: the inductive, deductive, analytical, synthetic and hermeneutic method. Finally, it has been verified that the criminalization of the crime of sexual harassment has had a minimal positive effect on the Peruvian population, since many behaviors with sexual connotations are not reported for fear of being fired, reprisals, shame, and because they are unaware of the means. appropriate to report.
