dc.description.abstractLa presente investigación titulada: “Criterios adoptados por los magistrados de la Corte de La Libertad, respecto del dolo feminicida, 2018-2019”, tiene como objetivo principal conocer y analizar si los Juzgados Penales Colegiados de La Corte Superior de Justicia de La Libertad, en los años 2018 y 2019, se han pronunciado respecto del dolo feminicida y, de ser así, cuáles fueron los criterios utilizados para motivar sus sentencias, más precisamente cuando se hace referencia a la expresión “por su condición de tal” prescrito en l Art. 108-B del Código Penal Peruano. Se pretende también, conocer y analizar los criterios más aceptados por los magistrados respecto del dolo feminicida, de ahí la necesidad de analizar los fallos emitidos, ya que en base a los criterios expuestos por los magistrados se determinará si se pronunciaron o no respecto del elemento de tendencia interna trascedente como elemento adicional al dolo de matar o causar la muerte de una mujer (dolo feminicida). En efecto, esta investigación pretende llegar a resultados y conclusiones importantes, ya que se ha analizado cada sentencia emitida; estableciendo los tesistas recomendaciones para contribuir a la correcta aplicación de nuestra legislación penal respecto del delito de feminicidio (Artículo 108-B C.P.) y por ende en la administración judicial.
dc.description.abstractABSTRACT The main objective of this investigation entitled: “Criteria adopted by the magistrates of the Court of La Libertad, regarding feminicide intent, 2018-2019”, is to know and analyze whether the collegiate Criminal Courts of the Superior Court of Justice of La Libertad, In the years 2018 and 2019, they have ruled on femicidal intent and, if so, what criteria did they use to motivate their sentences, more precisely when reference is made to “due to their status as such” prescribed in Art. 108-B of the Peruvian Penal Code. It is also intended to know and analyze the criteria most accepted by the magistrates regarding femicidal intent, hence the need to analyze the rulings issued, since based on the criteria set forth by the magistrates it will be determined whether or not they ruled on the element. of transcendent internal tendency as an additional element to the intent of killing or causing the death of a woman (feminicide intent). Indeed, this investigation aims to reach important results and conclusions, since each sentence issued has been analyzed; establishing the thesis, recommendations to contribute to the correct application of our criminal legislation regarding the crime of feminicide (Article 108-B C.P.) and therefore in the judicial administration.
