dc.description.abstractEl presente trabajo de investigación denominado “El recurso de reconsideración en el procedimiento administrativo general y la limitación al derecho de defensa”, tiene como propósito fundamental realizar un análisis del Texto Único Ordenado de la Ley N° 27444, Ley del Procedimiento Administrativo General, en cuanto al Recurso Administrativo de Reconsideración. Es por ello que, nuestra investigación gira en cuanto al tema referente a la nueva prueba exigida al administrado para poder interponer el Recurso de Reconsideración, mediante lo cual se limita su derecho de defensa. Dentro de esta investigación, se va determinar lo que conlleva la exigencia de la nueva prueba para poder interponer el Recurso de reconsideración y su impacto al Procedimiento Administrativo General, generando retraso en el desarrollo del mismo; por lo que tenemos como nuestro trabajo, el Texto Único Ordenado de la Ley N° 27444, Ley del Procedimiento Administrativo General. Finalmente, con la información recopilada y el análisis llevado a cabo, sustentamos que se debe eliminar la nueva prueba como requisito fundamental para poder interponer el Recurso Administrativo de Reconsideración; por lo que ello significa la limitación al derecho de defensa de los administrados.
dc.description.abstractABSTRACT The present research work called “The resource for reconsideration in the general administrative procedure and the limitation to the right of defense”, has as its main purpose an analysis of the Unique Text Ordered of Law No. 27444, Law of the General Administrative Procedure, in Regarding the Administrative Appeal for Reconsideration. That is why, our investigation revolves around the issue related to the new evidence required of the administrator in order to file the Appeal for Reconsideration, thereby limiting his right to defense. Within this investigation, it will be determined what the requirement of the new test entails in order to be able to file the Appeal for reconsideration and its impact on the General Administrative Procedure, generating delay in the development of the same; for what we have as the basis of our work, the Unique Ordered Text of Law No. 27444, General Administrative Procedure Law. Finally, with the information collected and the analysis carried out, we maintain that the new test must be eliminated as a fundamental requirement in order to file the Administrative Appeal for Reconsideration; for that reason it means the limitation to the right of defense of the administered ones.
