dc.descriptionThe present investigation seeks to determine what are the legal grounds for the granting of voluntary correction as exemption from liability, given that the administrative entities, considering that the LPAG does not regulate the scope of the exemption, through its regulations, have set guidelines and exceptions not provided for in the TUO of the LPAG, limiting the application of the exemption despite being a guarantee in favor of the company; thus affecting the rights of the administered as well as being faced with a non-uniform criterion that ends up violating the principle of legality, reasonableness and legal certainty. Now, regarding the dogmatic and jurisprudential development, the following chapters are developed: the sanctioning power, the dministrative infraction, the inspection activity and the responsive regulation policy, voluntary correction as an exemption from liability, regulations and jurisprudence issued by the administrative entities. Finally, it was determined that the legal grounds for the granting of voluntary correction as an exemption are to promote voluntary compliance with the rules and the restoration of legality, which is consistent with a responsive regulation policy that superimposes the preventive-corrective purpose for about the repressive purpose.es_PE
dc.description.abstractLa presente investigación busca determinar cuáles son los fundamentos jurídicos para el otorgamiento de la subsanación voluntaria como eximente de responsabilidad, dado que las entidades administrativas al considerar que el Texto Único Ordenado de la Ley de Procedimiento Administrativo General (TUO de la LPAG) no regula los alcances del eximente, través de sus reglamentos, han fijado pautas y excepciones no previstos en el TUO de la LPAG, limitando la aplicación del eximente a pesar de ser una garantía a favor del administrado; afectándose así los derechos del administrado así como estar frente a un criterio no uniforme que termina por vulnerar el principio de legalidad, razonabilidad y seguridad jurídica. Ahora, respecto al desarrollo dogmático y jurisprudencial, se desarrolla los siguientes capítulos: la potestad sancionadora, la infracción administrativa, la actividad de fiscalización y la política de regulación responsiva, subsanación voluntaria como eximente de responsabilidad, normativa y jurisprudencia emitidas por las entidades administrativas. Finalmente, se determinó que los fundamentos jurídicos para el otorgamiento de la subsanación voluntaria como eximente son promover el cumplimiento voluntario de las normas y el restablecimiento de la legalidad, los cuales se condice con una política de regulación responsiva que superpone el fin preventivo-correctivo por sobre el fin represivo.es_PE
